45 A BILL TO BE ENTITLED
56 AN ACT
67 relating to the authority of certain counties to cancel platted
78 subdivisions that have remained undeveloped.
89 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9- SECTION 1. Section 232.0085, Local Government Code, is
10- amended by amending Subsection (a) and adding Subsection (g) to
11- read as follows:

11+ amended to read as follows:
1212 (a) This section applies only to real property that
1313 [located]:
14- (1) is located [outside municipalities and the
15- extraterritorial jurisdiction of municipalities, as determined
16- under Chapter 42; and
17- [(2)] in the unincorporated area of an affected
18- county, as defined by Section 16.341, Water Code, that:

2322 jurisdiction of a municipality, is not subject to a written
2423 agreement under Section 242.001 that authorizes the municipality to
2524 regulate subdivision plats and approve related permits in the
2625 extraterritorial jurisdiction.
27- (g) Notwithstanding Section 232.0015(b) or any other law,
28- this section applies to a subdivision of land to which Subchapter B
29- applies.
3026 SECTION 2. This Act takes effect September 1, 2021.
