| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 418, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 418.0055 to read as follows: |
|---|
| 13 | 13 | | Sec. 418.0055. TRAINING FOR EMERGENCY MANAGEMENT COUNCIL |
|---|
| 14 | 14 | | AND STATE EMERGENCY RESPONSE COMMISSION. (a) In this section: |
|---|
| 15 | 15 | | (1) "Emergency management council" means the council |
|---|
| 16 | 16 | | established by the governor under Section 418.013. |
|---|
| 17 | 17 | | (2) "State emergency response commission" means the |
|---|
| 18 | 18 | | commission appointed by the governor in accordance with the federal |
|---|
| 19 | 19 | | Emergency Planning and Community Right-To-Know Act of 1986 (42 |
|---|
| 20 | 20 | | U.S.C. Section 11001(a)). |
|---|
| 21 | 21 | | (b) Except as provided by Subsection (c), each member of the |
|---|
| 22 | 22 | | emergency management council shall complete a training course on |
|---|
| 23 | 23 | | emergency management of at least 16 hours every two years. |
|---|
| 24 | 24 | | (c) Each member of the state emergency response commission |
|---|
| 25 | 25 | | shall complete a training course on emergency management of at |
|---|
| 26 | 26 | | least 40 hours every two years. A member of the commission who |
|---|
| 27 | 27 | | completes the training required by this subsection and who is a |
|---|
| 28 | 28 | | member of the emergency management council is not required to |
|---|
| 29 | 29 | | complete the training required by Subsection (b). |
|---|
| 30 | 30 | | (d) A person shall complete the training required by this |
|---|
| 31 | 31 | | section: |
|---|
| 32 | 32 | | (1) not later than the first anniversary of the date |
|---|
| 33 | 33 | | the person was appointed to the emergency management council or |
|---|
| 34 | 34 | | state emergency response commission for the initial training |
|---|
| 35 | 35 | | course; and |
|---|
| 36 | 36 | | (2) not later than each second anniversary of the |
|---|
| 37 | 37 | | deadline date provided by Subdivision (1) for each subsequent |
|---|
| 38 | 38 | | training course. |
|---|
| 39 | 39 | | (e) The division shall develop the minimum curriculum |
|---|
| 40 | 40 | | standards for the training courses required by this section. The |
|---|
| 41 | 41 | | division shall administer the training courses or approve training |
|---|
| 42 | 42 | | courses that meet the minimum curriculum standards established |
|---|
| 43 | 43 | | under this subsection. |
|---|
| 44 | 44 | | SECTION 2. Not later than September 1, 2022, each person |
|---|
| 45 | 45 | | serving on the emergency management council or state emergency |
|---|
| 46 | 46 | | response commission on the effective date of this Act shall |
|---|
| 47 | 47 | | complete the training required by Section 418.0055, Government |
|---|
| 48 | 48 | | Code, as added by this Act. |
|---|
| 49 | 49 | | SECTION 3. This Act takes effect September 1, 2021. |
