77 relating to training on emergency management for members of the
88 emergency management council and state emergency response
99 commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 418, Government Code, is
1212 amended by adding Section 418.0055 to read as follows:
1313 Sec. 418.0055. TRAINING FOR EMERGENCY MANAGEMENT COUNCIL
1414 AND STATE EMERGENCY RESPONSE COMMISSION. (a) In this section:
1515 (1) "Emergency management council" means the council
1616 established by the governor under Section 418.013.
1717 (2) "State emergency response commission" means the
1818 commission appointed by the governor in accordance with the federal
1919 Emergency Planning and Community Right-To-Know Act of 1986 (42
2020 U.S.C. Section 11001(a)).
2121 (b) Except as provided by Subsection (c), each member of the
2222 emergency management council shall complete a training course on
2323 emergency management of at least 16 hours every two years.
2424 (c) Each member of the state emergency response commission
2525 shall complete a training course on emergency management of at
2626 least 40 hours every two years. A member of the commission who
2727 completes the training required by this subsection and who is a
2828 member of the emergency management council is not required to
2929 complete the training required by Subsection (b).
3030 (d) A person shall complete the training required by this
3131 section:
3232 (1) not later than the first anniversary of the date
3333 the person was appointed to the emergency management council or
3434 state emergency response commission for the initial training
3535 course; and
3636 (2) not later than each second anniversary of the
3737 deadline date provided by Subdivision (1) for each subsequent
3838 training course.
3939 (e) The division shall develop the minimum curriculum
4040 standards for the training courses required by this section. The
4141 division shall administer the training courses or approve training
4242 courses that meet the minimum curriculum standards established
4343 under this subsection.
4444 SECTION 2. Not later than September 1, 2022, each person
4545 serving on the emergency management council or state emergency
4646 response commission on the effective date of this Act shall
4747 complete the training required by Section 418.0055, Government
4848 Code, as added by this Act.
4949 SECTION 3. This Act takes effect September 1, 2021.
