| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 2052, Insurance Code, is amended by |
|---|
| 11 | 11 | | adding Section 2052.005 to read as follows: |

| 12 | 12 | | Sec. 2052.005. CONTRACTS WITH ACCIDENT AND HEALTH INSURANCE |
|---|
| 13 | 13 | | COMPANIES TO PROVIDE MAJOR MEDICAL COVERAGE AND MEDICAL BENEFITS. |

| 14 | 14 | | (a) Subject to Subsection (c), a workers' compensation insurance |
|---|
| 15 | 15 | | company may contract with an accident and health insurance company |
|---|
| 16 | 16 | | to offer to employers a workers' compensation insurance policy and |
|---|
| 17 | 17 | | a group accident and health insurance policy together in one |
|---|
| 18 | 18 | | packaged plan under which employees and their dependents are |
|---|
| 19 | 19 | | eligible for major medical expense coverage and employees are |
|---|
| 20 | 20 | | covered for medical benefits and other benefits required by Chapter |
|---|
| 21 | 21 | | 408, Labor Code. |
|---|
| 22 | 22 | | (b) A packaged plan offered under this section must provide |
|---|
| 23 | 23 | | that medical examinations required under Subchapter A, Chapter 408, |
|---|
| 24 | 24 | | Labor Code, are covered exclusively under the workers' compensation |
|---|
| 25 | 25 | | insurance policy included in the packaged plan. |
|---|
| 26 | 26 | | (c) The commissioner must approve an agreement described by |
|---|
| 27 | 27 | | Subsection (a) and the policy forms to be used for the packaged |
|---|
| 28 | 28 | | plan. |
|---|
| 29 | 29 | | (d) The commissioner shall adopt rules as necessary to |
|---|
| 30 | 30 | | implement this section. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2022. |
