55 AN ACT
66 relating to restoring electric service to certain vulnerable
77 customers after a power outage.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter D, Chapter 38, Utilities Code, is
1010 amended by adding Section 38.0725 to read as follows:
1111 Sec. 38.0725. PRIORITIES FOR POWER RESTORATION TO CERTAIN
1212 CUSTOMERS. (a) The commission by rule shall require each retail
1313 electric provider to implement a process by which a customer of the
1414 provider may report to the provider that the customer has a serious
1515 medical condition that requires an electric-powered device.
1616 (b) A retail electric provider shall maintain customer
1717 information reported under this section to allow the retail
1818 electric provider to quickly identify vulnerable customers during a
1919 power outage and notify the relevant transmission and distribution
2020 utilities to prioritize those customers for power restoration.
2121 SECTION 2. As soon as practicable after the effective date
2222 of this Act, the Public Utility Commission of Texas shall adopt the
2323 rules required by Section 38.0725, Utilities Code, as added by this
2424 Act.
2525 SECTION 3. This Act takes effect September 1, 2021.
