410 AN ACT
511 relating to the financial exploitation of certain vulnerable
612 adults.
713 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
814 SECTION 1. Section 281.001(5), Finance Code, is amended to
915 read as follows:
1016 (5) "Vulnerable adult" means:
1117 (A) an elderly person as that term is defined by
1218 Section 48.002, Human Resources Code; or
1319 (B) a person with a disability as that term is
1420 defined by Section 48.002, Human Resources Code[; or
1521 [(C) an individual receiving services as that
1622 term is defined by rule by the executive commissioner of the Health
1723 and Human Services Commission as authorized by Section 48.251(b),
1824 Human Resources Code].
1925 SECTION 2. Sections 281.004(a) and (b), Finance Code, are
2026 amended to read as follows:
2127 (a) Notwithstanding any other law, [if] a financial
2228 institution [submits a report of suspected financial exploitation
2329 of a vulnerable adult to the department under Section 281.002(b),
2430 the financial institution]:
2531 (1) may place a hold on any transaction that[:
2632 [(A)] involves an account of a [the] vulnerable
2733 adult if[; and
2834 [(B)] the financial institution:
2935 (A) submits a report of suspected financial
3036 exploitation of the vulnerable adult to the department under
3137 Section 281.002(b); and
3238 (B) has cause to believe the transaction is
3339 related to the suspected financial exploitation alleged in the
3440 report; and
3541 (2) must place a hold on any transaction involving an
3642 account of a [the] vulnerable adult if the hold is requested by the
3743 department or a law enforcement agency.
3844 (b) Subject to Subsection (c), a hold placed on any
3945 transaction under Subsection (a) expires on the 10th business day
4046 after the date the hold is placed [the financial institution
4147 submits the report under Section 281.002(b)].
4248 SECTION 3. Sections 4004.355(a) and (b), Government Code,
4349 as effective January 1, 2022, are amended to read as follows:
4450 (a) Notwithstanding any other law, [if] a dealer or
4551 investment adviser [submits reports of suspected financial
4652 exploitation of a vulnerable adult to the commissioner and the
4753 department under Section 4004.352(b), the dealer or investment
4854 adviser]:
4955 (1) may place a hold on any transaction that[:
5056 [(A)] involves an account of a [the] vulnerable
5157 adult if[; and
5258 [(B)] the dealer or investment adviser:
5359 (A) submits a report of suspected financial
5460 exploitation of the vulnerable adult to the commissioner and the
5561 department under Section 4004.352(b); and
5662 (B) has cause to believe the transaction is
5763 related to the suspected financial exploitation alleged in the
5864 report; and
5965 (2) must place a hold on any transaction involving an
6066 account of a [the] vulnerable adult if the hold is requested by the
6167 commissioner, the department, or a law enforcement agency.
6268 (b) Subject to Subsection (c), a hold placed on any
6369 transaction under Subsection (a) expires on the 10th business day
6470 after the date the hold is placed [the dealer or investment adviser
6571 submits the reports under Section 4004.352(b)].
6672 SECTION 4. Subsections G and H, Section 45, The Securities
6773 Act (Article 581-45, Vernon's Texas Civil Statutes), are amended to
6874 read as follows:
6975 G. Notwithstanding any other law, [if] a dealer or
7076 investment adviser [submits reports of suspected financial
7177 exploitation of a vulnerable adult to the Securities Commissioner
7278 and the department under Subsection C of this section, the dealer or
7379 investment adviser]:
7480 (1) may place a hold on any transaction that[:
7581 [(A)] involves an account of a [the] vulnerable
7682 adult if[; and
7783 [(B)] the dealer or investment adviser:
7884 (A) submits a report of suspected financial
7985 exploitation of the vulnerable adult to the Securities Commissioner
8086 and the department under Subsection C of this section; and
8187 (B) has cause to believe the transaction is
8288 related to the suspected financial exploitation alleged in the
8389 report; and
8490 (2) must place a hold on any transaction involving an
8591 account of a [the] vulnerable adult if the hold is requested by the
8692 Securities Commissioner, the department, or a law enforcement
8793 agency.
8894 H. Subject to Subsection I of this section, a hold placed on
8995 any transaction under Subsection G of this section expires on the
9096 10th business day after the date the hold is placed [the dealer or
9197 investment adviser submits the reports under Subsection C of this
9298 section].
9399 SECTION 5. Except as otherwise provided by this Act, this
94100 Act takes effect September 1, 2021.
