55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirement that a state agency provide information
88 to another state agency on request.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 774, Government Code, is
1111 amended to read as follows:
1212 CHAPTER 774. EXCHANGE OF INFORMATION BETWEEN CERTAIN [REGULATORY]
1313 AGENCIES
1414 SECTION 2. Section 774.001, Government Code, is amended to
1515 read as follows:
1616 Sec. 774.001. DEFINITIONS. In this chapter:
1717 (1) "Health care provider" means a person who has been
1818 issued a license by a health care regulatory agency.
1919 (2) "Health care regulatory agency" means a regulatory
2020 agency that:
2121 (A) appoints a member of the Health Professions
2222 Council; or
2323 (B) is supervised by the health licensing
2424 division of the Texas Department of Health.
2525 (3) "License" includes a license, certificate,
2626 registration, permit, or other authorization, required by law or
2727 state agency rule, that a person must obtain to practice or engage
2828 in a particular business or occupation.
2929 (4) "Regulatory agency" means an agency, including a
3030 department, commission, board, or office, that:
3131 (A) is created by the constitution or by statute;
3232 (B) is in the executive branch of state
3333 government;
3434 (C) has statewide authority; and
3535 (D) has authority to deny, grant, renew, revoke,
3636 or suspend a license.
3737 (5) "State agency" means a department, commission,
3838 board, office, or other agency in the executive branch of state
3939 government, including a university system or institution of higher
4040 education as defined by Section 61.003, Education Code.
4141 SECTION 3. Chapter 774, Government Code, is amended by
4242 adding Section 774.004 to read as follows:
4343 Sec. 774.004. EXCHANGE OF INFORMATION BETWEEN STATE
4444 AGENCIES. (a) A state agency that receives a written request for
4545 information, other than information that is confidential under law,
4646 from another state agency shall provide the information to the
4747 requesting agency not later than the 10th day following the date the
4848 request is received.
4949 (b) A state agency that receives a request under this
5050 section must provide the information to the requesting state agency
5151 without cost.
5252 SECTION 4. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2021.
