| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 2252.201(1), Government Code, is amended | |
| 12 | 12 | to read as follows: | |
| 13 | 13 | (1) "Governmental entity" means this state or a board, | |
| 14 | 14 | commission, department, office, or other agency in the executive | |
| 15 | 15 | branch of state government, including an institution of higher | |
| 16 | 16 | education as defined by Section 61.003, Education Code. The term | |
| 17 | 17 | does not include a political subdivision. | |
| 18 | 18 | SECTION 2. The changes in law made by this Act apply only to | |
| 19 | 19 | bid documents submitted or contracts entered into on or after the | |
| 20 | 20 | effective date of this Act. | |
| 21 | 21 | SECTION 3. This Act takes effect September 1, 2021. |
