66 relating to compliance with the National Voter Registration Act.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter A, Chapter 13, Election Code, is
99 amended by adding Section 13.009 to read as follows:
1010 Sec. 13.009. VOTER REGISTRATION IN A SIMULTANEOUS
1111 TRANSACTION FOR DRIVER'S LICENSE RENEWALS BY PERSONS ELIGIBLE. (a)
1212 The secretary of state and the Department of Public Safety shall
1313 jointly implement a program to allow a person who is a citizen of
1414 the United States and has an unexpired driver's license issued in
1515 this state to complete a voter registration application
1616 simultaneously with the person's application for an original,
1717 renewal, or duplicate driver's license and from the official
1818 Internet website of this state. The Internet websites of the
1919 secretary of state and the Department of Public Safety must also
2020 provide a link to the location of the application on the official
2121 Internet website of this state.
2222 (b) An applicant for electronic voter registration must:
2323 (1) attest to the truth of the information provided on
2424 the application by affirmatively accepting the information as true;
2525 (2) affirmatively consent to the use of the signature
2626 on the applicant's driver's license or personal identification card
2727 for voter registration purposes;
2828 (3) provide the information required under Section
2929 13.002(c); and
3030 (4) provide the audit number and date of issuance of
3131 the applicant's Texas driver's license issued by the Department of
3232 Public Safety.
3333 (c) For each application the program shall:
3434 (1) require that a digital copy of the applicant's
3535 signature be obtained from the Department of Public Safety; and
3636 (2) compare the information provided by the applicant
3737 against Department of Public Safety records.
3838 (d) If the information submitted by an applicant does not
3939 match Department of Public Safety records, the program shall:
4040 (1) notify the applicant that the application is
4141 incomplete; and
4242 (2) advise the applicant to correct and resubmit the
4343 application.
4444 (e) If the information submitted by an applicant matches
4545 Department of Public Safety records, the program shall forward the
4646 application to the registrar of the county in which the applicant
4747 states that the applicant resides and to the secretary of state.
4848 (f) An application electronically submitted under this
4949 section is considered for all purposes as an application submitted
5050 by mail under this title.
5151 (g) The secretary of state shall adopt rules as necessary to
5252 implement this section, including rules to provide for additional
5353 security measures necessary to ensure the accuracy and integrity of
5454 applications submitted electronically.
5555 (h) The rules adopted under Subsection (g) must require
5656 that:
5757 (1) the Internet website through which a person may
5858 complete a voter registration application include a description of
5959 the offense described by Section 13.007 in a conspicuous location
6060 on the website near the place where the person begins or submits the
6161 application; and
6262 (2) the state electronic Internet portal project be
6363 used to authenticate the identity of a person who submits an
6464 application electronically under this section.
6565 SECTION 2. Section 13.071, Election Code, is amended by
6666 adding Subsections (a-1) and (c) and amending Subsection (b) to
6767 read as follows:
6868 (a-1) The registrar shall send each submitted application
6969 determined eligible for registration to the secretary of state for
7070 verification.
7171 SECTION 3. Sections 13.143(a) and (d-2), Election Code, are
7272 amended to read as follows:
7373 (a) Except as provided by Subsection [Subsections] (b) [and
7474 (e)], if an applicant's registration application is approved, the
7575 registration becomes effective on the 30th day after the date the
7676 application is approved [submitted to the registrar] or on the date
7777 the applicant becomes 18 years of age, whichever is later.
7878 (d-2) For a registration application not submitted by
7979 personal delivery or mail [telephonic facsimile machine] to be
8080 effective, a copy of the original registration application
8181 containing the voter's original signature must be submitted by
8282 personal delivery or mail and be received by the registrar not later
8383 than the fourth business day after the submission [transmission by
8484 telephonic facsimile machine] is received.
8585 (b) If the application is submitted to the Department of
8686 Public Safety in conjunction with an application for an original,
8787 renewal, or duplicate driver's license the application shall be
8888 approved, rejected, or challenged under this subchapter [The
8989 registrar shall make the determination] not later than the seventh
9090 day after the date it was [the application is] submitted to the
9191 registrar.
9292 (c) If the application is submitted in a manner other than
9393 the manner described by Subsection (b), the registrar shall forward
9494 the information relating to the applicant to the secretary of state
9595 for determining correct information necessary to prevent duplicate
9696 voter registrations and assess the eligibility of the applicant as
9797 provided by Section 13.0721. The registrar shall not accept an
9898 application under this subsection until the secretary of state has
9999 notified the registrar the applicant meets the requirements of
100100 Section 13.001. The secretary of state shall adopt rules and
101101 prescribe procedures to implement this subsection.
102102 SECTION 4. Section 13.072, Election Code, is amended to
103103 read as follows:
104104 Sec. 13.072. ACTION ON APPLICATION. (a) Unless the
105105 registrar challenges the applicant, the registrar shall approve the
106106 application if:
107107 (1) the registrar determines that an application
108108 complies with Section 13.002 and indicates that the applicant is
109109 eligible for registration under Section 13.001; and
110110 (2) for an applicant who has not included a statement
111111 described by Section 13.002(c)(8)(C), the registrar verifies with
112112 the secretary of state:
113113 (A) the applicant's Texas driver's license number
114114 or number of a personal identification card issued by the
115115 Department of Public Safety; or
116116 (B) the last four digits of the applicant's
117117 social security number.
118118 (3) for an applicant who has included a statement
119119 described by Section 13.002(c)(8)(C), the registrar has forwarded
120120 the application to the secretary of state and the secretary of state
121121 has verified the identity of the applicant. The secretary of state
122122 shall adopt rules and prescribe procedures to implement this
123123 subsection.
124124 (b) After approval of an application by an applicant who was
125125 registered in another county at the time of application, the
126126 registrar shall deliver written notice of the applicant's change of
127127 residence to the other county's registrar and include in the notice
128128 the applicant's name, former residence address, and former
129129 registration number, if known.
130130 (c) Except as provided by Subsection (d), if the registrar
131131 determines that an application does not comply with Section 13.002
132132 or does not indicate that the applicant is eligible for
133133 registration under Section 13.001, the registrar shall reject the
134134 application.
135135 (d) If an application clearly indicates that the applicant
136136 resides in another county, the registrar shall forward the
137137 application to the other county's registrar not later than the
138138 second day after the date the application is received [and, if the
139139 other county is not contiguous, shall deliver written notice of
140140 that action to the applicant not later than the seventh day after
141141 the date the application is received]. The date of submission of a
142142 completed application to the wrong registrar is considered to be
143143 the date of submission to the proper registrar for purposes of
144144 determining the effective date of the registration.
145145 SECTION 5. Section 18.062, Election Code, is amended by
146146 adding Subsection (c) to read as follows:
147147 (c) To the extent practicable, a system developed under this
148148 section shall allow real-time verification of identity,
149149 eligibility and residency.
150150 SECTION 6. Section 20.062, Election Code, is amended by
151151 amending Subsection (a) and adding Subsection (d) to read as
152152 follows:
153153 (a) The Department of Public Safety shall prescribe and use
154154 a form and procedure that combines the department's application
155155 form for a license or card with an officially prescribed voter
156156 registration application form for each United States citizen who
157157 applies in person at the department's offices or using the
158158 procedure provided in Section 13.009.
159159 (d) A procedure prescribed under this section must provide
160160 for the electronic transmission of an applicant's voter
161161 registration data by the department to the secretary of state in
162162 accordance with Section 20.066.
163163 SECTION 7. Sections 20.063, Election Code, is amended to
164164 read as follows:
165165 (a) The Department of Public Safety shall provide to each
166166 United States Citizenperson who applies in person or using the
167167 procedure provided in Section 13.009 [at the department's offices]
168168 for an original or renewal of a driver's license, a personal
169169 identification card, or a duplicate or corrected license or card an
170170 opportunity to complete a voter registration application in a
171171 simultaneous transaction [form].
172172 (b) The department shall prescribe and use a change of
173173 address form and procedure that combines department and voter
174174 registration functions. The form must allow a licensee or
175175 cardholder to indicate that [whether] the change of address is not
176176 [also to be used] for voter registration purposes.
177177 (c) A change of address that relates to a license or card and
178178 that is submitted to the department in person, [or] by mail, or
179179 using the procedure provided in Section 13.009 serves as a change of
180180 address for voter registration unless the licensee or cardholder
181181 indicates that the change is not for voter registration purposes.
182182 The date of submission of a change of address to a department
183183 employee is considered to be the date of submission to the voter
184184 registrar for the purpose of determining the effective date of
185185 registration [only].
186186 SECTION 8. Section 20.065(b), Election Code, is amended to
187187 read as follows:
188188 (b) Each weekday the department is regularly open for
189189 business, the department shall electronically transfer to the
190190 secretary of state the name and information designated by the
191191 secretary of state for [of each person who completes a] voter
192192 registration for each individual who is eligible to vote as
193193 provided by Section 13.001 and applies in person, by mail, or using
194194 the procedure provided in Section 13.009 for an original or renewal
195195 of a driver's license, [application submitted to the department].
196196 The secretary shall prescribe procedures necessary to implement
197197 this subsection.
198198 SECTION 9. Sections 13.143(d) and (e), Election Code, are
199199 repealed.
200200 SECTION 10. The changes in law made by this Act apply only
201201 to an application to register to vote submitted on or after the
202202 effective date of this Act.
203203 SECTION 11. This Act takes effect September 1, 2021.
