| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 383.002, Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 383.002. LEGISLATIVE INTENT. This chapter furthers |
|---|
| 13 | 13 | | the public purpose of developing and diversifying the economy of |
|---|
| 14 | 14 | | the counties of this state by providing incentives for the location |
|---|
| 15 | 15 | | and development of projects [in certain counties] to attract |
|---|
| 16 | 16 | | visitors and tourists. |
|---|
| 17 | 17 | | SECTION 2. Sections 383.003(a) and (b), Local Government |
|---|
| 18 | 18 | | Code, are amended to read as follows: |
|---|
| 19 | 19 | | (a) Counties [Small and medium-sized counties] in this |
|---|
| 20 | 20 | | state need incentives for the development of public improvements to |
|---|
| 21 | 21 | | attract visitors and tourists. Counties in this state [to those |
|---|
| 22 | 22 | | counties, and those counties] are at a disadvantage in competing |
|---|
| 23 | 23 | | with counties in other states for the location and development of |
|---|
| 24 | 24 | | projects that attract visitors by virtue of the availability and |
|---|
| 25 | 25 | | prevalent use of financial incentives in other states. |
|---|
| 26 | 26 | | (b) The means and measures authorized by this chapter are in |
|---|
| 27 | 27 | | the public interest and serve a public purpose of this state in |
|---|
| 28 | 28 | | promoting the economic welfare of the residents of this state by |
|---|
| 29 | 29 | | providing incentives for the location and development [in certain |
|---|
| 30 | 30 | | counties of this state] of projects that attract visitors and |
|---|
| 31 | 31 | | tourists and that result in employment and economic activity. |
|---|
| 32 | 32 | | SECTION 3. Section 383.021(a), Local Government Code, is |
|---|
| 33 | 33 | | amended to read as follows: |
|---|
| 34 | 34 | | (a) The commissioners court of a county [with a population |
|---|
| 35 | 35 | | of 400,000 or less], on petition of the owners of land in a proposed |
|---|
| 36 | 36 | | district, may commence the creation of a county development |
|---|
| 37 | 37 | | district. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2021. |
