55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the adoption of rules by the Texas Commission on
88 Environmental Quality regarding the discharge into water in this
99 state of produced water resulting from certain oil and gas
1010 activities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 26.131, Water Code, as effective until
1313 delegation of authority under the Resource Conservation and
1414 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
1515 Railroad Commission of Texas, is amended by amending Subsection (d)
1616 and adding Subsection (e) to read as follows:
1717 (d) The commission may issue permits for the discharge into
1818 water in this state of produced water, hydrostatic test water, and
1919 gas plant effluent resulting from the activities described by
2020 Subsection (a) on delegation to the commission of NPDES authority
2121 for those discharges. The discharge of produced water, hydrostatic
2222 test water, and gas plant effluent into water in this state under
2323 this subsection must meet the water quality standards established
2424 by the commission, including the standards established under
2525 Subsection (e).
2626 (e) The commission shall adopt rules governing the
2727 discharge, handling, treatment, and disposition of produced water
2828 resulting from the activities described by Subsection (a). Rules
2929 adopted under this section must:
3030 (1) be based on the best available science and
3131 technology;
3232 (2) impose standards that exceed the minimum standards
3333 established by 40 C.F.R. Parts 435 and 437, as those provisions
3434 existed on January 15, 2021;
3535 (3) prohibit a discharge of untreated produced water
3636 into water in this state;
3737 (4) prohibit a discharge of treated produced water
3838 into water in this state unless the commission determines that the
3939 discharge will not result in water pollution, including a violation
4040 of anti-degradation standards;
4141 (5) prohibit a discharge of treated produced water to
4242 impaired state waters, unless advanced and secondary treatment
4343 standards can be implemented that will prevent further degradation
4444 of the impaired water;
4545 (6) require a person who proposes to discharge treated
4646 produced water, or to treat produced water for activities unrelated
4747 to oil or gas operations, to provide to the commission for public
4848 disclosure the water contaminants in the untreated produced water,
4949 including constituents added for oil or gas drilling or production;
5050 and
5151 (7) require a thorough characterization of all
5252 contaminants present in the produced water, including the
5353 contaminants' toxicity, mobility, radioactivity, and propensity to
5454 bioaccumulate.
5555 SECTION 2. Section 26.131, Water Code, as effective upon
5656 delegation of authority under the Resource Conservation and
5757 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
5858 Railroad Commission of Texas, is amended by amending Subsection (c)
5959 and adding Subsection (d) to read as follows:
6060 (c) The commission may issue permits for the discharge into
6161 water in this state of produced water, hydrostatic test water, and
6262 gas plant effluent resulting from the activities described by
6363 Subsection (a) on delegation to the commission of NPDES authority
6464 for those discharges. The discharge of produced water, hydrostatic
6565 test water, and gas plant effluent into water in this state under
6666 this subsection must meet the water quality standards established
6767 by the commission, including the standards established under
6868 Subsection (d).
6969 (d) The commission shall adopt rules governing the
7070 discharge, handling, treatment, and disposition of produced water
7171 resulting from the activities described by Subsection (a). Rules
7272 adopted under this section must:
7373 (1) be based on the best available science and
7474 technology;
7575 (2) impose standards that exceed the minimum standards
7676 established by 40 C.F.R. Parts 435 and 437, as those provisions
7777 existed on January 15, 2021;
7878 (3) prohibit a discharge of untreated produced water
7979 into water in this state;
8080 (4) prohibit a discharge of treated produced water
8181 into water in this state unless the commission determines that the
8282 discharge will not result in water pollution, including a violation
8383 of anti-degradation standards;
8484 (5) prohibit a discharge of treated produced water to
8585 impaired state waters, unless advanced and secondary treatment
8686 standards can be implemented that will prevent further degradation
8787 of the impaired water;
8888 (6) require a person who proposes to discharge treated
8989 produced water, or to treat produced water for activities unrelated
9090 to oil or gas operations, to provide to the commission for public
9191 disclosure the water contaminants in the untreated produced water,
9292 including constituents added for oil or gas drilling or production;
9393 and
9494 (7) require a thorough characterization of all
9595 contaminants present in the produced water, including the
9696 contaminants' toxicity, mobility, radioactivity, and propensity to
9797 bioaccumulate.
9898 SECTION 3. (a) Not later than September 1, 2022, the
9999 commission shall adopt rules required by Section 26.131, Water
100100 Code, as amended by this Act.
101101 (b) Rules adopted under Section 26.131, Water Code, as
102102 amended by this Act, become effective on the effective date of
103103 delegation of National Pollutant Discharge Elimination System
104104 permit authority for discharges of produced water to the Texas
105105 Commission on Environmental Quality by the United States
106106 Environmental Protection Agency under Section 402(b) of the Federal
107107 Water Pollution Control Act (33 U.S.C. Section 1342(b)).
108108 SECTION 4. This Act takes effect September 1, 2021.
