55 AN ACT
66 relating to the provision of home dialysis care by a dialysis
77 technician.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 251, Health and Safety
1010 Code, is amended by adding Section 251.033 to read as follows:
1111 Sec. 251.033. PROVISION OF HOME DIALYSIS CARE. (a) A
1212 dialysis technician may provide home dialysis care, including
1313 hemodialysis, only if:
1414 (1) the care is provided under the direct supervision
1515 of a registered nurse who is employed by the same entity that
1616 employs the dialysis technician; and
1717 (2) the dialysis technician has:
1818 (A) complied with all executive commissioner
1919 rules on training and competency for dialysis technicians; and
2020 (B) successfully completed orientation and
2121 skills education requirements equivalent to the requirements for a
2222 registered or licensed vocational nurse who provides home dialysis
2323 care.
2424 (b) For purposes of this section, "direct supervision"
2525 means supervision by a registered nurse who is physically present
2626 on the premises, but not necessarily present in the room where the
2727 dialysis services are provided, at which a dialysis technician
2828 provides home dialysis care and is immediately available to respond
2929 to patient needs.
3030 SECTION 2. As soon as practicable after the effective date
3131 of this Act, the executive commissioner of the Health and Human
3232 Services Commission shall adopt rules necessary to implement
3333 Section 251.033, Health and Safety Code, as added by this Act.
3434 SECTION 3. This Act takes effect September 1, 2021.
