55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reporting of political contributions from a person
88 with a principal address that is located outside this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 254.031(a), Election Code, is amended to
1111 read as follows:
1212 (a) Except as otherwise provided by this chapter, each
1313 report filed under this chapter must include:
1414 (1) the amount of political contributions, other than
1515 political contributions described by Subdivision (1-a) or (1-b),
1616 from each person that in the aggregate exceed $50 and that are
1717 accepted during the reporting period by the person or committee
1818 required to file a report under this chapter, the full name and
1919 address of the person making the contributions, and the dates of the
2020 contributions;
2121 (1-a) the amount of political contributions from each
2222 person that are made electronically and that are accepted during
2323 the reporting period by the person or committee required to file a
2424 report under this chapter, the full name and address of the person
2525 making the contributions, and the dates of the contributions;
2626 (1-b) the amount of political contributions, other than
2727 political contributions described by Subdivision (1) or (1-a),
2828 from each person with a principal address that is located outside
2929 this state and that are accepted during the reporting period by the
3030 person or committee required to file a report under this chapter,
3131 the full name and address of the person making the contributions,
3232 and the dates of the contributions;
3333 (2) the amount of loans that are made during the
3434 reporting period for campaign or officeholder purposes to the
3535 person or committee required to file the report and that in the
3636 aggregate exceed $50, the dates the loans are made, the interest
3737 rate, the maturity date, the type of collateral for the loans, if
3838 any, the full name and address of the person or financial
3939 institution making the loans, the full name and address, principal
4040 occupation, and name of the employer of each guarantor of the loans,
4141 the amount of the loans guaranteed by each guarantor, and the
4242 aggregate principal amount of all outstanding loans as of the last
4343 day of the reporting period;
4444 (3) the amount of political expenditures that in the
4545 aggregate exceed $100 and that are made during the reporting
4646 period, the full name and address of the persons to whom the
4747 expenditures are made, and the dates and purposes of the
4848 expenditures;
4949 (4) the amount of each payment made during the
5050 reporting period from a political contribution if the payment is
5151 not a political expenditure, the full name and address of the person
5252 to whom the payment is made, and the date and purpose of the
5353 payment;
5454 (5) the total amount or a specific listing of the
5555 political contributions of $50 or less accepted and the total
5656 amount or a specific listing of the political expenditures of $100
5757 or less made during the reporting period;
5858 (6) the total amount of all political contributions
5959 accepted and the total amount of all political expenditures made
6060 during the reporting period;
6161 (7) the name of each candidate or officeholder who
6262 benefits from a direct campaign expenditure made during the
6363 reporting period by the person or committee required to file the
6464 report, and the office sought or held, excluding a direct campaign
6565 expenditure that is made by the principal political committee of a
6666 political party on behalf of a slate of two or more nominees of that
6767 party;
6868 (8) as of the last day of a reporting period for which
6969 the person is required to file a report, the total amount of
7070 political contributions accepted, including interest or other
7171 income on those contributions, maintained in one or more accounts
7272 in which political contributions are deposited as of the last day of
7373 the reporting period;
7474 (9) any credit, interest, rebate, refund,
7575 reimbursement, or return of a deposit fee resulting from the use of
7676 a political contribution or an asset purchased with a political
7777 contribution that is received during the reporting period and the
7878 amount of which exceeds $100;
7979 (10) any proceeds of the sale of an asset purchased
8080 with a political contribution that is received during the reporting
8181 period and the amount of which exceeds $100;
8282 (11) any investment purchased with a political
8383 contribution that is received during the reporting period and the
8484 amount of which exceeds $100;
8585 (12) any other gain from a political contribution that
8686 is received during the reporting period and the amount of which
8787 exceeds $100; and
8888 (13) the full name and address of each person from whom
8989 an amount described by Subdivision (9), (10), (11), or (12) is
9090 received, the date the amount is received, and the purpose for which
9191 the amount is received.
9292 SECTION 2. The change in law made by this Act applies only
9393 to a report of political contributions and expenditures under
9494 Chapter 254, Election Code, that is required to be filed on or after
9595 January 1, 2022.
9696 SECTION 3. This Act takes effect September 1, 2021.
