| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 621.101, Transportation Code, is amended |
|---|
| 11 | 13 | | by adding Subsection (b-2) to read as follows: |
|---|
| 12 | 14 | | (b-2) Notwithstanding Subsections (a)(1) and (2), a vehicle |
|---|
| 13 | 15 | | or combination of vehicles that is transporting aggregates, as |
|---|
| 14 | 16 | | defined by Section 28A.001, Water Code, may operate at an axle |
|---|
| 15 | 17 | | weight that is not heavier than the weight equal to the maximum |
|---|
| 16 | 18 | | allowable axle weight provided by those subsections plus a |
|---|
| 17 | 19 | | tolerance allowance of 15 percent of that allowable weight. |

| 18 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 19 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 20 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 21 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 22 | 24 | | Act takes effect September 1, 2021. |
