5	8		AN ACT
6	9		relating to the prohibition of tolls on portions of State Highway
7	10		146 and State Highway 99.
8	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	12		SECTION 1. The heading to Subchapter E, Chapter 228,
10	13		Transportation Code, is amended to read as follows:
11	14		SUBCHAPTER E. LIMITATION ON TOLL FACILITY DESIGNATION, TOLL
12	15		COLLECTION, AND [;] CONVERSION OF NONTOLLED STATE HIGHWAY
13	16		SECTION 2. Subchapter E, Chapter 228, Transportation Code,
14	17		is amended by adding Section 228.202 to read as follows:
15	18		Sec. 228.202. TOLLS PROHIBITED ON PORTIONS OF STATE HIGHWAY
16	19		146 AND STATE HIGHWAY 99. The department may not charge a toll,
17	20		either directly or indirectly through an agreement with another
18	21		entity, on:
19	22		(1) the portion of State Highway 146 that crosses the
20	23		Houston Ship Channel; or
21	24		(2) the portion of State Highway 99 between its
22		-	intersection with State Highway 146 and its ~~intersection with~~
23		-	~~Interstate 10~~.
	25	+	intersection with State Highway 146 and its crossing of Cedar
	26	+	Bayou.
24	27		SECTION 3. This Act takes effect immediately if it receives
25	28		a vote of two-thirds of all the members elected to each house, as
26	29		provided by Section 39, Article III, Texas Constitution. If this
27	30		Act does not receive the vote necessary for immediate effect, this
28	31		Act takes effect September 1, 2021.
