| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39.309, Education Code, is amended by |
|---|
| 11 | 11 | | amending Subsections (a), (b) and (c) to read as follows: |
|---|
| 12 | 12 | | Sec. 39.309. TEXAS SCHOOL ACCOUNTABILITY DASHBOARD |
|---|
| 13 | 13 | | INTERNET WEBSITE. (a) The agency shall develop and maintain an |
|---|
| 14 | 14 | | Internet website, separate from the agency's Internet website, to |
|---|
| 15 | 15 | | be known as the Texas School Accountability Dashboard for the |
|---|
| 16 | 16 | | public to access school district and campus accountability |
|---|
| 17 | 17 | | information. |
|---|
| 18 | 18 | | (b) The commissioner shall adopt, for use on the Texas |
|---|
| 19 | 19 | | School Accountability Dashboard, a performance index in each of the |
|---|
| 20 | 20 | | following areas: |
|---|
| 21 | 21 | | (1) student achievement; |
|---|
| 22 | 22 | | (2) student progress; |
|---|
| 23 | 23 | | (3) closing performance gaps; and |
|---|
| 24 | 24 | | (4) postsecondary readiness. |
|---|
| 25 | 25 | | (c) The Texas School Accountability DashboardInternet |
|---|
| 26 | 26 | | website developed under Subsection (a) must include: |
|---|
| 27 | 27 | | (1) performance information for each school district |
|---|
| 28 | 28 | | and campus in areas specified by Subsection (b) and must allow for |
|---|
| 29 | 29 | | comparison of performance between districts and campuses in each of |
|---|
| 30 | 30 | | the areas; |
|---|
| 31 | 31 | | (2) a comparison of the number of students enrolled in |
|---|
| 32 | 32 | | each school district, including: |
|---|
| 33 | 33 | | (A) the percentage of students of limited English |
|---|
| 34 | 34 | | proficiency, as defined by Section 29.052; |
|---|
| 35 | 35 | | (B) the percentage of students who are unschooled |
|---|
| 36 | 36 | | asylees or refugees, as defined by Section 39.027(a-1); |
|---|
| 37 | 37 | | (C) the percentage of students who are |
|---|
| 38 | 38 | | educationally disadvantaged; and |
|---|
| 39 | 39 | | (D) the percentage of students with |
|---|
| 40 | 40 | | disabilities; |
|---|
| 41 | 41 | | (3) a comparison of performance information for each |
|---|
| 42 | 42 | | district and campus disaggregated by race, ethnicity, and |
|---|
| 43 | 43 | | populations served by special programs, including special |
|---|
| 44 | 44 | | education, bilingual education, and special language programs; and |
|---|
| 45 | 45 | | (4) a comparison of performance information by subject |
|---|
| 46 | 46 | | area. |
|---|
| 47 | 47 | | SECTION 2. Section 39.363, Education Code, is amended to |
|---|
| 48 | 48 | | read as follows: |
|---|
| 49 | 49 | | Sec. 39.363. NOTICE ON AGENCY WEBSITE. Not later than |
|---|
| 50 | 50 | | October 1 of each year, the agency shall make the following |
|---|
| 51 | 51 | | information available to the public on the agency's Internet |
|---|
| 52 | 52 | | website: |
|---|
| 53 | 53 | | (1) the letter performance rating assigned to each |
|---|
| 54 | 54 | | school district and campus under Section 39.054 and each |
|---|
| 55 | 55 | | distinction designation awarded to a school district or campus |
|---|
| 56 | 56 | | under Subchapter G; and |
|---|
| 57 | 57 | | (2) the performance rating assigned to a school |
|---|
| 58 | 58 | | district and each campus in the district by the district under |
|---|
| 59 | 59 | | Section 39.0545; and |
|---|
| 60 | 60 | | (3) the financial accountability rating assigned to |
|---|
| 61 | 61 | | each school district and open-enrollment charter school under |
|---|
| 62 | 62 | | Section 39.082. |
|---|
| 63 | 63 | | SECTION 3. Section 39.201, Education Code, is amended by |
|---|
| 64 | 64 | | amending Subsections (a) to read as follows: |
|---|
| 65 | 65 | | Sec. 39.201. DISTINCTION DESIGNATIONS. (a) Not later than |
|---|
| 66 | 66 | | August 815 of each year, the commissioner shall award distinction |
|---|
| 67 | 67 | | designations for outstanding performance as provided by this |
|---|
| 68 | 68 | | subchapter. A distinction designation awarded to a district or |
|---|
| 69 | 69 | | campus under this subchapter shall be referenced directly in |
|---|
| 70 | 70 | | connection with the performance rating assigned to the district or |
|---|
| 71 | 71 | | campus and made publicly available together with the performance |
|---|
| 72 | 72 | | ratings as provided by rules adopted under Section 39.054(a). |
|---|
| 73 | 73 | | SECTION 4. Subchapter Z, Chapter 39A, Education Code is |
|---|
| 74 | 74 | | amended by adding Section 39A.908 to read as follows: |
|---|
| 75 | 75 | | Section 39.201, Education Code, is amended by amending |
|---|
| 76 | 76 | | Subsections (a) to read as follows: |
|---|
| 77 | 77 | | Sec. 39A.908. RULES. (a) The commissioner shall adopt |
|---|
| 78 | 78 | | rules as necessary to administer this chapter. |
|---|
| 79 | 79 | | SECTION 5. The following provisions of the Education Code |
|---|
| 80 | 80 | | are repealed: |
|---|
| 81 | 81 | | (1) Section 39A.115; |
|---|
| 82 | 82 | | (2) Section 39A.117(d); |
|---|
| 83 | 83 | | (3) Section 39A.161; and |
|---|
| 84 | 84 | | (4) Section 39A.252(a). |
|---|
| 85 | 85 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 86 | 86 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 87 | 87 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 88 | 88 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 89 | 89 | | Act takes effect September 1, 2021. |
