66 Relating to a Texas school accountability Internet website; posting
77 of accountability information; release of distinction

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.309, Education Code, is amended by
1111 amending Subsections (a), (b) and (c) to read as follows:
1212 Sec. 39.309. TEXAS SCHOOL ACCOUNTABILITY DASHBOARD
1313 INTERNET WEBSITE. (a) The agency shall develop and maintain an
1414 Internet website, separate from the agency's Internet website, to
1515 be known as the Texas School Accountability Dashboard for the
1616 public to access school district and campus accountability
1717 information.
1818 (b) The commissioner shall adopt, for use on the Texas
1919 School Accountability Dashboard, a performance index in each of the
2020 following areas:
2121 (1) student achievement;
2222 (2) student progress;
2323 (3) closing performance gaps; and
2424 (4) postsecondary readiness.
2525 (c) The Texas School Accountability DashboardInternet
2626 website developed under Subsection (a) must include:
2727 (1) performance information for each school district
2828 and campus in areas specified by Subsection (b) and must allow for
2929 comparison of performance between districts and campuses in each of
3030 the areas;
3131 (2) a comparison of the number of students enrolled in
3232 each school district, including:
3333 (A) the percentage of students of limited English
3434 proficiency, as defined by Section 29.052;
3535 (B) the percentage of students who are unschooled
3636 asylees or refugees, as defined by Section 39.027(a-1);
3737 (C) the percentage of students who are
3838 educationally disadvantaged; and
3939 (D) the percentage of students with
4040 disabilities;
4141 (3) a comparison of performance information for each
4242 district and campus disaggregated by race, ethnicity, and
4343 populations served by special programs, including special
4444 education, bilingual education, and special language programs; and
4545 (4) a comparison of performance information by subject
4646 area.
4747 SECTION 2. Section 39.363, Education Code, is amended to
4848 read as follows:
4949 Sec. 39.363. NOTICE ON AGENCY WEBSITE. Not later than
5050 October 1 of each year, the agency shall make the following
5151 information available to the public on the agency's Internet
5252 website:
5353 (1) the letter performance rating assigned to each
5454 school district and campus under Section 39.054 and each
5555 distinction designation awarded to a school district or campus
5656 under Subchapter G; and
5757 (2) the performance rating assigned to a school
5858 district and each campus in the district by the district under
5959 Section 39.0545; and
6060 (3) the financial accountability rating assigned to
6161 each school district and open-enrollment charter school under
6262 Section 39.082.
6363 SECTION 3. Section 39.201, Education Code, is amended by
6464 amending Subsections (a) to read as follows:
6565 Sec. 39.201. DISTINCTION DESIGNATIONS. (a) Not later than
6666 August 815 of each year, the commissioner shall award distinction
6767 designations for outstanding performance as provided by this
6868 subchapter. A distinction designation awarded to a district or
6969 campus under this subchapter shall be referenced directly in
7070 connection with the performance rating assigned to the district or
7171 campus and made publicly available together with the performance
7272 ratings as provided by rules adopted under Section 39.054(a).
7373 SECTION 4. Subchapter Z, Chapter 39A, Education Code is
7474 amended by adding Section 39A.908 to read as follows:
7575 Section 39.201, Education Code, is amended by amending
7676 Subsections (a) to read as follows:
7777 Sec. 39A.908. RULES. (a) The commissioner shall adopt
7878 rules as necessary to administer this chapter.
7979 SECTION 5. The following provisions of the Education Code
8080 are repealed:
8181 (1) Section 39A.115;
8282 (2) Section 39A.117(d);
8383 (3) Section 39A.161; and
8484 (4) Section 39A.252(a).
8585 SECTION 6. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2021.
