44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the creation of a commission to study land titles.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. DEFINITION. In this Act, "land title" means the
99 initial conveyance of real property in this state, as evidenced by a
1010 certificate, title, or patent.
1111 SECTION 2. LAND TITLE REVIEW COMMISSION. (a) The Land
1212 Title Review Commission is created to study and provide
1313 recommendations on providing alternative remedies to disputed land
1414 title claims before litigation is pursued.
1515 (b) The commission shall determine:
1616 (1) the feasibility in creating a review board that is
1717 tasked with establishing title in the name of the appropriate owner
1818 of real property if title is not contested by another person; and
1919 (2) the legal impacts of a possible review board that
2020 establishes title in the name of the appropriate owner of real
2121 property if title is not contested by another person
2222 (c) The commission consists of the following members:
2323 (1) three members who have expertise in land title
2424 claims, appointed by the governor;
2525 (2) three members who have expertise in property law,
2626 appointed by the governor;
2727 (3) a designee of the lieutenant governor;
2828 (4) a designee of the speaker;
2929 (5) a designee of the commissioner of the General Land
3030 Office;
3131 (6) a designee of the comptroller;
3232 (7) a designee of the attorney general;
3333 (d) When making initial appointments under Subsection (c),
3434 the governor shall designate one of the governor's appointees as
3535 presiding officer of the commission.
3636 (e) Members of the commission shall be appointed or
3737 designated, as appropriate, not later than December 31, 2021.
3838 (f) The commission shall meet not later than the 30th day
3939 after the date initial appointments or designations are made under
4040 Subsection (c) and shall meet regularly as necessary at the call of
4141 the presiding officer.
4242 (g) A commission member is not entitled to reimbursement of
4343 expenses or to compensation.
4444 (h) On the commission's request, the comptroller or any
4545 other state agency, department, or office shall provide any
4646 assistance the commission needs to perform the commission's duties.
4747 SECTION 3. REPORT ON LAND TITLE REVIEW. Not later than
4848 January 1, 2023, the commission shall provide to the governor,
4949 lieutenant governor, and speaker of the house of representatives a
5050 final report on the feasibility of an alternative land title
5151 review. The final report must include:
5252 (1) recommendation for how a land title review board
5353 would operate and review land title disputes;
5454 (2) pertinent case law that would be impacted by a land
5555 title review process;
5656 (3) proposed legislation necessary to implement the
5757 recommendations made in the final report;
5858 (4) any administrative recommendations proposed by
5959 the commission; and
6060 (5) a complete explanation of each of the commission's
6161 recommendations.
6262 SECTION 4. OTHER LAW. The commission is not subject to
6363 Chapter 2110, Government Code.
6464 SECTION 5. EXPIRATION DATE. This Act expires and the Land
6565 Title Review Commission is abolished on June 1, 2023.
6666 SECTION 6. EFFECTIVE DATE. This Act takes effect September
6767 1, 2021.
