8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Subtitle H, Title 2, Health and Safety Code, is |
---|
10 | 10 | | amended by adding Chapter 174 to read as follows: |
---|
11 | 11 | | CHAPTER 174. PREGNANCY RESOURCE CENTERS |
---|
12 | 12 | | Sec. 174.001. DEFINITION. In this chapter, "pregnancy |
---|
13 | 13 | | resource center" means an organization, including a pregnancy |
---|
14 | 14 | | counseling organization, crisis pregnancy center, pregnancy care |
---|
15 | 15 | | center, or pregnancy support center, that for a fee or free of |
---|
16 | 16 | | charge provides pregnancy counseling or information but: |
---|
17 | 17 | | (1) does not perform abortions or make referrals to an |
---|
18 | 18 | | abortion provider; |
---|
19 | 19 | | (2) does not provide or make referrals for |
---|
20 | 20 | | comprehensive birth control services; |
---|
21 | 21 | | (3) is not licensed or certified by this state or the |
---|
22 | 22 | | federal government to provide medical or health care services; and |
---|
23 | 23 | | (4) is not required to have a physician under contract |
---|
24 | 24 | | to provide or directly supervise all health care services provided |
---|
25 | 25 | | by the organization. |
---|
26 | 26 | | Sec. 174.002. REPORTING REQUIREMENTS. (a) Each pregnancy |
---|
27 | 27 | | resource center shall submit a monthly report to the commission |
---|
28 | 28 | | containing information on each patient receiving services provided |
---|
29 | 29 | | by the center. The report must be submitted on the form prescribed |
---|
30 | 30 | | by the commission and made available on the commission's Internet |
---|
31 | 31 | | website. |
---|
32 | 32 | | (b) The report must include: |
---|
33 | 33 | | (1) the licensing status of the center; |
---|
34 | 34 | | (2) each patient's year of birth, race, marital |
---|
35 | 35 | | status, and county and state of residence; |
---|
36 | 36 | | (3) the type of services provided; |
---|
37 | 37 | | (4) the date the services were provided; |
---|
38 | 38 | | (5) the probable post-fertilization age of the unborn |
---|
39 | 39 | | child based on the best judgment of the attending physician or other |
---|
40 | 40 | | health care practitioner at the time services were provided; |
---|
41 | 41 | | (6) the date, if known, of each patient's last |
---|
42 | 42 | | menstrual cycle; |
---|
43 | 43 | | (7) the number of previous live births of each |
---|
44 | 44 | | patient; and |
---|
45 | 45 | | (8) the number of previous induced abortions of each |
---|
46 | 46 | | patient, if applicable. |
---|
47 | 47 | | (c) Not later than the 15th day of each month, the pregnancy |
---|
48 | 48 | | resource center shall submit to the commission the report required |
---|
49 | 49 | | by this section for each person receiving services provided by the |
---|
50 | 50 | | center in the preceding calendar month. |
---|
51 | 51 | | (d) The commission shall provide the information submitted |
---|
52 | 52 | | under this section biannually in a report to the members of the |
---|
53 | 53 | | legislature. |
---|
54 | 54 | | (e) The commission shall remove the name, birth date, and |
---|
55 | 55 | | any other personal identifying information of a patient from a |
---|
56 | 56 | | report submitted under Subsection (d). |
---|
57 | 57 | | (f) A pregnancy resource center or health care practitioner |
---|
58 | 58 | | that violates this section is subject to disciplinary action by the |
---|
59 | 59 | | state agency that regulates the center or practitioner as if the |
---|
60 | 60 | | center or practitioner had violated the applicable licensing law. |
---|
61 | 61 | | SECTION 2. This Act takes effect September 1, 2021. |
