77 relating to pregnancy resource center reporting requirements.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1010 amended by adding Chapter 174 to read as follows:
1111 CHAPTER 174. PREGNANCY RESOURCE CENTERS
1212 Sec. 174.001. DEFINITION. In this chapter, "pregnancy
1313 resource center" means an organization, including a pregnancy
1414 counseling organization, crisis pregnancy center, pregnancy care
1515 center, or pregnancy support center, that for a fee or free of
1616 charge provides pregnancy counseling or information but:
1717 (1) does not perform abortions or make referrals to an
1818 abortion provider;
1919 (2) does not provide or make referrals for
2020 comprehensive birth control services;
2121 (3) is not licensed or certified by this state or the
2222 federal government to provide medical or health care services; and
2323 (4) is not required to have a physician under contract
2424 to provide or directly supervise all health care services provided
2525 by the organization.
2626 Sec. 174.002. REPORTING REQUIREMENTS. (a) Each pregnancy
2727 resource center shall submit a monthly report to the commission
2828 containing information on each patient receiving services provided
2929 by the center. The report must be submitted on the form prescribed
3030 by the commission and made available on the commission's Internet
3131 website.
3232 (b) The report must include:
3333 (1) the licensing status of the center;
3434 (2) each patient's year of birth, race, marital
3535 status, and county and state of residence;
3636 (3) the type of services provided;
3737 (4) the date the services were provided;
3838 (5) the probable post-fertilization age of the unborn
3939 child based on the best judgment of the attending physician or other
4040 health care practitioner at the time services were provided;
4141 (6) the date, if known, of each patient's last
4242 menstrual cycle;
4343 (7) the number of previous live births of each
4444 patient; and
4545 (8) the number of previous induced abortions of each
4646 patient, if applicable.
4747 (c) Not later than the 15th day of each month, the pregnancy
4848 resource center shall submit to the commission the report required
4949 by this section for each person receiving services provided by the
5050 center in the preceding calendar month.
5151 (d) The commission shall provide the information submitted
5252 under this section biannually in a report to the members of the
5353 legislature.
5454 (e) The commission shall remove the name, birth date, and
5555 any other personal identifying information of a patient from a
5656 report submitted under Subsection (d).
5757 (f) A pregnancy resource center or health care practitioner
5858 that violates this section is subject to disciplinary action by the
5959 state agency that regulates the center or practitioner as if the
6060 center or practitioner had violated the applicable licensing law.
6161 SECTION 2. This Act takes effect September 1, 2021.
