55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to adding a special purpose territory to the Port of Port
88 Arthur Navigation District of Jefferson County, Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 197, Acts of the 58th Legislature,
1111 Regular Session, 1963, is amended by adding Section 1A to read as
1212 follows:
1313 Sec. 1A. (a) In this section, "special purpose area" means
1414 the territory described by Subsection (e) of this section.
1515 (b) Waterborne commercial cargo and vessel movements
1616 originating in or departing from the special purpose area may be
1717 attributed as waterborne commercial cargo or vessel movements
1818 originating in or departing from the district for the purpose of
1919 reporting to the United States Army Corps of Engineers under
2020 applicable federal law.
2121 (c) The inclusion in the district of the special purpose
2222 area does not affect any powers or duties exercised in the special
2323 purpose area by the Sabine-Neches Navigation District or the Port
2424 of Beaumont Navigation District of Jefferson County, Texas.
2525 (d) The district may not impose a tax in the special purpose
2626 area.
2727 (e) In addition to the territory described by Section 1 of
2828 this Act, the Port of Port Arthur Navigation District of Jefferson
2929 County, Texas, includes the following tract as a special purpose
3030 area:
3131 BEING 133.8 ± acres of land and water, part of the Neches
3232 River in the City of Port Arthur, Jefferson County, Texas; said
3333 133.8 ± acre tract being more fully described by metes and bounds as
3434 follows, to wit:
3535 BEGINNING at a point on the intersection of the thread of the
3636 Neches River with the current city limits of the City of Port
3737 Arthur, as described in Annexation Ordinance No. 2540, for the most
3838 northerly comer of the herein described tract;
3939 THENCE, in a southeasterly direction, with the thread of the
4040 Neches River, a distance of 7885'± to its intersection with the
4141 current boundary of the Port of Port Arthur Navigation District on
4242 the centerline of State Highway 87, for the most easterly comer of
4343 the herein described tract;
4444 THENCE, in a southwesterly direction, on the centerline of
4545 State Highway 87, being the current boundary of the Port of Port
4646 Arthur Navigation District, a distance of 690'± to a point on the
4747 projected southwesterly bank of the Neches River, for the most
4848 southerly comer of the herein described tract;
4949 THENCE, in a northwesterly direction, on the Southwest bank
5050 of the Neches River, a distance of 9000'± to its intersection with
5151 the Northwest line of City of Port Arthur Annexation Ordinance
5252 No. 2540, same being the southeasterly line of a (Called 16.130)
5353 acre tract of land, known as Tract Five, Parcel SE, recorded in File
5454 No. 2020000404, Official Public Records, Jefferson County, Texas,
5555 for the most westerly comer of the herein described tract;
5656 THENCE, in a northeasterly direction, on the Northwest line
5757 of City of Port Arthur Annexation Ordinance No. 2540, a distance of
5858 1045'± to the POINT OF BEGINNING, and containing 133.8 ± acres of
5959 land, more or less.
6060 SECTION 2. (a) The legal notice of the intention to
6161 introduce this Act, setting forth the general substance of this
6262 Act, has been published as provided by law, and the notice and a
6363 copy of this Act have been furnished to all persons, agencies,
6464 officials, or entities to which they are required to be furnished
6565 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6666 Government Code.
6767 (b) The governor, one of the required recipients, has
6868 submitted the notice and Act to the Texas Commission on
6969 Environmental Quality.
7070 (c) The Texas Commission on Environmental Quality has filed
7171 its recommendations relating to this Act with the governor, the
7272 lieutenant governor, and the speaker of the house of
7373 representatives within the required time.
7474 (d) All requirements of the constitution and laws of this
7575 state and the rules and procedures of the legislature with respect
7676 to the notice, introduction, and passage of this Act are fulfilled
7777 and accomplished.
7878 SECTION 3. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2021.
