9+ A BILL TO BE ENTITLED
410 AN ACT
511 relating to the authority of the Chambers County Improvement
612 District No. 1 to issue bonds and impose certain taxes or
713 assessments.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Section 3854.152, Special District Local Laws
1016 Code, is amended to read as follows:
1117 Sec. 3854.152. ELECTIONS. Except as provided by Section
1218 3854.202, the [The] district shall hold elections as provided by
1319 Subchapter L, Chapter 375, Local Government Code.
1420 SECTION 2. Section 3854.202, Special District Local Laws
1521 Code, is amended by amending Subsection (a) and adding Subsection
1622 (c) to read as follows:
1723 (a) Except as provided by Subsection (c), the [The] district
1824 shall hold an election in the manner provided by Subchapter L,
1925 Chapter 375, Local Government Code, to obtain voter approval for
2026 the district to impose a maintenance tax or issue bonds payable from
2127 ad valorem taxes or assessments.
2228 (c) Section 375.243, Local Government Code, does not apply
2329 to the district.
2430 SECTION 3. Section 3854.205(b), Special District Local Laws
2531 Code, is amended to read as follows:
2632 (b) A petition under Section 375.114 or 375.243, Local
2733 Government Code, is not required for the board to levy a tax,
2834 assessment, or impact fee to finance improvement projects and
2935 services under this chapter.
3036 SECTION 4. Sections 3854.209(b), (c), and (d), Special
3137 District Local Laws Code, are repealed.
3238 SECTION 5. (a) The legal notice of the intention to
3339 introduce this Act, setting forth the general substance of this
3440 Act, has been published as provided by law, and the notice and a
3541 copy of this Act have been furnished to all persons, agencies,
3642 officials, or entities to which they are required to be furnished
3743 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3844 Government Code.
3945 (b) The governor, one of the required recipients, has
4046 submitted the notice and Act to the Texas Commission on
4147 Environmental Quality.
4248 (c) The Texas Commission on Environmental Quality has filed
4349 its recommendations relating to this Act with the governor,
4450 lieutenant governor, and speaker of the house of representatives
4551 within the required time.
4652 (d) All requirements of the constitution and laws of this
4753 state and the rules and procedures of the legislature with respect
4854 to the notice, introduction, and passage of this Act have been
4955 fulfilled and accomplished.
5056 SECTION 6. This Act takes effect immediately if it receives
5157 a vote of two-thirds of all the members elected to each house, as
5258 provided by Section 39, Article III, Texas Constitution. If this
5359 Act does not receive the vote necessary for immediate effect, this
5460 Act takes effect September 1, 2021.
