8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Section 3854.152, Special District Local Laws |
---|
10 | 16 | | Code, is amended to read as follows: |
---|
11 | 17 | | Sec. 3854.152. ELECTIONS. Except as provided by Section |
---|
12 | 18 | | 3854.202, the [The] district shall hold elections as provided by |
---|
13 | 19 | | Subchapter L, Chapter 375, Local Government Code. |
---|
14 | 20 | | SECTION 2. Section 3854.202, Special District Local Laws |
---|
15 | 21 | | Code, is amended by amending Subsection (a) and adding Subsection |
---|
16 | 22 | | (c) to read as follows: |
---|
17 | 23 | | (a) Except as provided by Subsection (c), the [The] district |
---|
18 | 24 | | shall hold an election in the manner provided by Subchapter L, |
---|
19 | 25 | | Chapter 375, Local Government Code, to obtain voter approval for |
---|
20 | 26 | | the district to impose a maintenance tax or issue bonds payable from |
---|
21 | 27 | | ad valorem taxes or assessments. |
---|
22 | 28 | | (c) Section 375.243, Local Government Code, does not apply |
---|
23 | 29 | | to the district. |
---|
24 | 30 | | SECTION 3. Section 3854.205(b), Special District Local Laws |
---|
25 | 31 | | Code, is amended to read as follows: |
---|
26 | 32 | | (b) A petition under Section 375.114 or 375.243, Local |
---|
27 | 33 | | Government Code, is not required for the board to levy a tax, |
---|
28 | 34 | | assessment, or impact fee to finance improvement projects and |
---|
29 | 35 | | services under this chapter. |
---|
30 | 36 | | SECTION 4. Sections 3854.209(b), (c), and (d), Special |
---|
31 | 37 | | District Local Laws Code, are repealed. |
---|
32 | 38 | | SECTION 5. (a) The legal notice of the intention to |
---|
33 | 39 | | introduce this Act, setting forth the general substance of this |
---|
34 | 40 | | Act, has been published as provided by law, and the notice and a |
---|
35 | 41 | | copy of this Act have been furnished to all persons, agencies, |
---|
36 | 42 | | officials, or entities to which they are required to be furnished |
---|
37 | 43 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
38 | 44 | | Government Code. |
---|
39 | 45 | | (b) The governor, one of the required recipients, has |
---|
40 | 46 | | submitted the notice and Act to the Texas Commission on |
---|
41 | 47 | | Environmental Quality. |
---|
42 | 48 | | (c) The Texas Commission on Environmental Quality has filed |
---|
43 | 49 | | its recommendations relating to this Act with the governor, |
---|
44 | 50 | | lieutenant governor, and speaker of the house of representatives |
---|
45 | 51 | | within the required time. |
---|
46 | 52 | | (d) All requirements of the constitution and laws of this |
---|
47 | 53 | | state and the rules and procedures of the legislature with respect |
---|
48 | 54 | | to the notice, introduction, and passage of this Act have been |
---|
49 | 55 | | fulfilled and accomplished. |
---|
50 | 56 | | SECTION 6. This Act takes effect immediately if it receives |
---|
51 | 57 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 58 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 59 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 60 | | Act takes effect September 1, 2021. |
