The district's powers and duties include water control and improvement district powers and, subject to certain requirements such as compliance with a municipal consent ordinance or resolution, the authority to undertake road projects; issue obligations; and impose property, operation and maintenance, and contract taxes. The bill prohibits the district from exercising the power of eminent domain outside the district boundaries to acquire a site or easement for a recreational facility or a road project. The district may not exercise the power of eminent domain at all unless the bill receives a two-thirds vote of all the members elected to each house. EFFECTIVE DATE On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
