7 | 7 | | relating to the operations of the Nueces County Hospital District, |

8 | 8 | | including the operations of a health care provider participation |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. The heading to Section 281.094, Health and |
---|
12 | 12 | | Safety Code, is amended to read as follows: |
---|
13 | 13 | | Sec. 281.094. USE OF [CERTAIN] FUNDS BY THE NUECES COUNTY |
---|
14 | 14 | | HOSPITAL DISTRICT. |
---|
15 | 15 | | SECTION 2. Section 281.094(a), Health and Safety Code, is |
---|
16 | 16 | | amended to read as follows: |
---|
17 | 17 | | (a) The [With the approval of the Nueces County |
---|
18 | 18 | | Commissioners Court, the] board of the Nueces County Hospital |
---|
19 | 19 | | District may use funds made available to the district from any |
---|
20 | 20 | | source [sources other than a tax levy] to fund health care services |
---|
21 | 21 | | for residents of the district, including public health services, |
---|
22 | 22 | | mental health and intellectual disability [mental retardation] |
---|
23 | 23 | | services, emergency medical services, health services provided to |
---|
24 | 24 | | persons confined in jail facilities, and for other health related |
---|
25 | 25 | | purposes if: |
---|
26 | 26 | | (1) the board determines the district has funds |
---|
27 | 27 | | available that are in addition to the funds necessary to satisfy the |
---|
28 | 28 | | district's obligation to fund indigent health care for residents of |
---|
29 | 29 | | the district; and |
---|
30 | 30 | | (2) the Nueces County Commissioners Court approves of |
---|
31 | 31 | | the board's use of the funds. |
---|
32 | 32 | | SECTION 3. Section 298C.004, Health and Safety Code, as |
---|
33 | 33 | | added by Chapter 694 (S.B. 2315), Acts of the 86th Legislature, |
---|
34 | 34 | | Regular Session, 2019, is amended to read as follows: |
---|
35 | 35 | | Sec. 298C.004. EXPIRATION. (a) Subject to Section |
---|
36 | 36 | | 298C.153(d), the authority of the district to administer and |
---|
37 | 37 | | operate a program under this chapter expires December 31, 2023 |
---|
38 | 38 | | [2021]. |
---|
39 | 39 | | (b) This chapter expires December 31, 2023 [2021]. |
---|
40 | 40 | | SECTION 4. This Act takes effect immediately if it receives |
---|
41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 44 | | Act takes effect September 1, 2021. |
