410 AN ACT
511 relating to the creation of the New Waverly Municipal Management
612 District No. 1; providing authority to issue bonds and impose
713 assessments, fees, and taxes.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1016 Code, is amended by adding Chapter 3992 to read as follows:
1117 CHAPTER 3992. NEW WAVERLY MUNICIPAL MANAGEMENT DISTRICT NO. 1
1218 SUBCHAPTER A. GENERAL PROVISIONS
1319 Sec. 3992.0101. DEFINITIONS. In this chapter:
1420 (1) "Board" means the district's board of directors.
1521 (2) "City" means the City of New Waverly, Texas.
1622 (3) "Commission" means the Texas Commission on
1723 Environmental Quality.
1824 (4) "Director" means a board member.
1925 (5) "District" means the New Waverly Municipal
2026 Management District No. 1.
2127 Sec. 3992.0102. CREATION AND NATURE OF DISTRICT. The
2228 district is a special district created under Sections 52 and 52-a,
2329 Article III, and Section 59, Article XVI, Texas Constitution.
2430 Sec. 3992.0103. PURPOSE; LEGISLATIVE FINDINGS. (a) The
2531 creation of the district is essential to accomplish the purposes of
2632 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2733 Texas Constitution, and other public purposes stated in this
2834 chapter. By creating the district and in authorizing the city and
2935 other political subdivisions to contract with the district, the
3036 legislature has established a program to accomplish the public
3137 purposes set out in Section 52-a, Article III, Texas Constitution.
3238 (b) The creation of the district is necessary to promote,
3339 develop, encourage, and maintain employment, commerce,
3440 transportation, housing, tourism, recreation, the arts,
3541 entertainment, economic development, safety, and the public
3642 welfare in the district.
3743 (c) This chapter and the creation of the district may not be
3844 interpreted to relieve the city from providing the level of
3945 services provided to the area in the district as of the effective
4046 date of the Act enacting this chapter. The district is created to
4147 supplement and not to supplant the city services provided in the
4248 district.
4349 Sec. 3992.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4450 (a) The district is created to serve a public use and benefit.
4551 (b) All land and other property included in the district
4652 will benefit from the improvements and services to be provided by
4753 the district under powers conferred by Sections 52 and 52-a,
4854 Article III, and Section 59, Article XVI, Texas Constitution, and
4955 other powers granted under this chapter.
5056 (c) The district is created to accomplish the purposes of a
5157 municipal management district as provided by general law and
5258 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
5359 Texas Constitution.
5460 (d) The creation of the district is in the public interest
5561 and is essential to:
5662 (1) further the public purposes of developing and
5763 diversifying the economy of the state;
5864 (2) eliminate unemployment and underemployment;
5965 (3) develop or expand transportation and commerce; and
6066 (4) provide quality residential housing.
6167 (e) The district will:
6268 (1) promote the health, safety, and general welfare of
6369 residents, employers, potential employees, employees, visitors,
6470 and consumers in the district, and of the public;
6571 (2) provide needed funding for the district to
6672 preserve, maintain, and enhance the economic health and vitality of
6773 the district territory as a community and business center;
6874 (3) promote the health, safety, welfare, and enjoyment
6975 of the public by providing pedestrian ways and by landscaping and
7076 developing certain areas in the district, which are necessary for
7177 the restoration, preservation, and enhancement of scenic beauty;
7278 and
7379 (4) provide for water, wastewater, drainage, road, and
7480 recreational facilities for the district.
7581 (f) Pedestrian ways along or across a street, whether at
7682 grade or above or below the surface, and street lighting, street
7783 landscaping, parking, and street art objects are parts of and
7884 necessary components of a street and are considered to be a street
7985 or road improvement.
8086 (g) The district will not act as the agent or
8187 instrumentality of any private interest even though the district
8288 will benefit many private interests as well as the public.
8389 Sec. 3992.0105. DISTRICT TERRITORY. (a) The district is
8490 composed of the territory described by Section 2 of the Act enacting
8591 this chapter, as that territory may have been modified under other
8692 law.
8793 (b) The boundaries and field notes contained in Section 2 of
8894 the Act enacting this chapter form a closure. A mistake in the
8995 field notes or in copying the field notes in the legislative process
9096 does not affect the district's:
9197 (1) organization, existence, or validity;
9298 (2) right to contract;
9399 (3) authority to borrow money or issue bonds or other
94100 obligations or to pay the principal and interest of the bonds or
95101 other obligations;
96102 (4) right to impose or collect an assessment, or
97103 collect other revenue; or
98104 (5) legality or operation.
99105 Sec. 3992.0106. APPLICABILITY OF MUNICIPAL MANAGEMENT
100106 DISTRICTS LAW. Except as otherwise provided by this chapter,
101107 Chapter 375, Local Government Code, applies to the district.
102108 Sec. 3992.0107. CONSTRUCTION OF CHAPTER. This chapter
103109 shall be liberally construed in conformity with the findings and
104110 purposes stated in this chapter.
105111 Sec. 3992.0108. CONFLICTS OF LAW. This chapter prevails
106112 over any provision of Chapter 375, Local Government Code, that is in
107113 conflict or inconsistent with this chapter.
108114 Sec. 3992.0109. CONSENT OF MUNICIPALITY REQUIRED. The
109115 board may not hold an election to authorize the issuance of bonds
110116 until the governing body of the city by ordinance or resolution
111117 consents to the creation of the district and to the inclusion of
112118 land in the district. The city's consent must be granted in the
113119 manner provided by Section 54.016, Water Code, for including land
114120 within the corporate limits or extraterritorial jurisdiction of a
115121 city.
116122 SUBCHAPTER B. BOARD OF DIRECTORS
117123 Sec. 3992.0201. GOVERNING BODY; TERMS. (a) The district is
118124 governed by a board of five directors who serve staggered terms of
119125 four years, with two or three directors' terms expiring June 1 of
120126 each even-numbered year.
121127 (b) The governing body of the city, by a majority vote,
122128 shall appoint one member of the board.
123129 (c) The commission shall appoint four members of the board
124130 in the manner provided by Section 3992.0202.
125131 Sec. 3992.0202. APPOINTMENT BY COMMISSION. (a) Before the
126132 term of a director appointed by the commission expires, the board
127133 shall recommend to the commission a person to serve as a successor
128134 director. The commission shall appoint as director the person
129135 recommended by the board.
130136 (b) A person recommended by the board under Subsection (a)
131137 must be:
132138 (1) at least 18 years of age;
133139 (2) an owner of property in the district;
134140 (3) an owner of stock, whether beneficial or
135141 otherwise, of a corporate owner of property in the district;
136142 (4) an owner of a beneficial interest in a trust that
137143 owns property in the district; or
138144 (5) an agent, employee, or tenant of a person
139145 described by Subdivision (2), (3), or (4).
140146 Sec. 3992.0203. VACANCY. (a) Except as provided by
141147 Subsection (b), if a vacancy occurs on the board, the remaining
142148 directors shall appoint a director for the remainder of the
143149 unexpired term.
144150 (b) If a vacancy occurs in the position of the board member
145151 appointed by the city, the city shall appoint a director for the
146152 remainder of the unexpired term.
147153 Sec. 3992.0204. COMPENSATION; EXPENSES. (a) The district
148154 may compensate each director in an amount not to exceed $150 for
149155 each board meeting. The total amount of compensation a director may
150156 receive each year may not exceed $7,200.
151157 (b) A director is entitled to reimbursement for necessary
152158 and reasonable expenses incurred in carrying out the duties and
153159 responsibilities of the board.
154160 Sec. 3992.0205. INITIAL DIRECTORS. (a) On or after the
155161 effective date of the Act enacting this chapter, the owner or owners
156162 of a majority of the assessed value of the real property in the
157163 district according to the most recent certified tax appraisal rolls
158164 for the county may submit a petition to the commission requesting
159165 that the commission appoint as initial directors four persons named
160166 in the petition. The commission shall appoint as initial directors
161167 the persons named in the petition.
162168 (b) The initial directors, including the initial
163169 city-appointed director, shall determine by lot which three
164170 positions expire June 1, 2024, and which two positions expire June
165171 1, 2022.
166172 (c) This section expires September 1, 2025.
167173 SUBCHAPTER C. POWERS AND DUTIES
168174 Sec. 3992.0301. GENERAL POWERS AND DUTIES. The district
169175 has the powers and duties necessary to accomplish the purposes for
170176 which the district is created.
171177 Sec. 3992.0302. IMPROVEMENT PROJECTS AND SERVICES. The
172178 district may provide, design, construct, acquire, improve,
173179 relocate, operate, maintain, or finance an improvement project or
174180 service using money available to the district for the purpose, or
175181 contract with a governmental or private entity to provide, design,
176182 construct, acquire, improve, relocate, operate, maintain, or
177183 finance an improvement project or service authorized under this
178184 chapter or Chapter 375, Local Government Code.
179185 Sec. 3992.0303. LOCATION OF IMPROVEMENT PROJECT. A
180186 district improvement project may be located inside or outside of
181187 the district.
182188 Sec. 3992.0304. NO EMINENT DOMAIN. The district may not
183189 exercise the power of eminent domain.
184190 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
185191 Sec. 3992.0401. DISBURSEMENTS AND TRANSFERS OF MONEY. The
186192 board by resolution shall establish the number of directors'
187193 signatures and the procedure required for a disbursement or
188194 transfer of the district's money.
189195 Sec. 3992.0402. MONEY USED FOR IMPROVEMENTS OR SERVICES.
190196 The district may acquire, construct, or finance an improvement
191197 project or service authorized by this chapter or Chapter 375, Local
192198 Government Code, using any money available to the district for that
193199 purpose.
194200 SUBCHAPTER E. TAXES AND BONDS
195201 Sec. 3992.0501. OPERATION AND MAINTENANCE TAX. The
196202 district may impose an operation and maintenance tax on taxable
197203 property in the district for any district purpose in the manner
198204 provided by Section 49.107, Water Code, if authorized by a majority
199205 of the district voters voting at an election held in accordance with
200206 the Water Code, the Election Code, and any other applicable law,
201207 including for:
202208 (1) maintaining and operating the district;
203209 (2) constructing or acquiring improvements; or
204210 (3) providing a service.
205211 Sec. 3992.0502. TAXES FOR BONDS AND OTHER OBLIGATIONS. At
206212 the time bonds or other obligations payable wholly or partly from ad
207213 valorem taxes are issued:
208214 (1) the board shall impose a continuing direct annual
209215 ad valorem tax for each year that all or part of the bonds are
210216 outstanding; and
211217 (2) the board annually shall impose an ad valorem tax
212218 on all taxable property in the district in an amount sufficient to:
213219 (A) pay the interest on the bonds or other
214220 obligations as the interest becomes due; and
215221 (B) create a sinking fund for the payment of the
216222 principal of the bonds or other obligations when due or the
217223 redemption price at any earlier required redemption date.
218224 SECTION 2. The New Waverly Municipal Management District
219225 No. 1 initially includes all the territory contained in the
220226 following area:
221227 Tract 1 - 101.605 Acres:

547553 (b) The governor, one of the required recipients, has
548554 submitted the notice and Act to the Texas Commission on
549555 Environmental Quality.
550556 (c) The Texas Commission on Environmental Quality has filed
551557 its recommendations relating to this Act with the governor,
552558 lieutenant governor, and speaker of the house of representatives
553559 within the required time.
554560 (d) All requirements of the constitution and laws of this
555561 state and the rules and procedures of the legislature with respect
556562 to the notice, introduction, and passage of this Act have been
557563 fulfilled and accomplished.
558564 SECTION 4. This Act takes effect immediately if it receives
559565 a vote of two-thirds of all the members elected to each house, as
560566 provided by Section 39, Article III, Texas Constitution. If this
561567 Act does not receive the vote necessary for immediate effect, this
562568 Act takes effect September 1, 2021.
