6	6	AN ACT
7	7	relating to special purpose territory of the Orange County
8	8	Navigation and Port District of Orange County, Texas.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 5018, Special District Local Laws Code,
11	11	as effective April 1, 2021, is amended by adding Subchapter F to
12	12	read as follows:
13	13	SUBCHAPTER F. SPECIAL PURPOSE AREA
14	14	Sec. 5018.0301. DEFINITION. In this subchapter, "special
15	15	purpose area" means the territory described by Section 2 of the Act
16	16	enacting this subchapter.
17	17	Sec. 5018.0302. REPORTING OF CARGO AND VESSEL MOVEMENTS.
18	18	(a) Waterborne commercial cargo and vessel movements originating
19	19	in or departing from the special purpose area may be attributed as
20	20	waterborne commercial cargo or vessel movements originating in or
21	21	departing from the Port of Beaumont Navigation District of
22	22	Jefferson County, Texas, for the purpose of reporting to the United
23	23	States Army Corps of Engineers under applicable federal law.
24	24	(b) Waterborne commercial cargo and vessel movements
25	25	originating in or departing from the territory of the district not
26	26	including the special purpose area may be attributed as waterborne
27	27	commercial cargo or vessel movements originating in or departing
28	28	from the district for the purpose of reporting to the United States
29	29	Army Corps of Engineers under applicable federal law.
30	30	SECTION 2. The following tract is designated as a special
31	31	purpose area for the purposes of Subchapter F, Chapter 5018,
32	32	Special District Local Laws Code, as added by this Act:
33	33	BEING 265.4 ± acres of land, part of the Neches River, the
34	34	William Stephenson Survey, Abstract No. 23, and the Gilbert
35	35	Stevenson Survey, Abstract No. 167, Orange County, Texas; being all
36	36	of a (Called 250) acre tract of land, known as Tract 12, described
37	37	in a deed to Port of Beaumont Navigation District, recorded in
38	38	Volume 123, Page 376, Deed Records, Orange County, Texas, and all of
39	39	a (Called 108.9935) acre tract, described in a Quitclaim Deed to the
40	40	Port of Beaumont Navigation District, recorded in Volume 955, Page
41	41	34, Official Public Records, Orange County, Texas; said 265.4 ±
42	42	acre tract being more fully described by metes and follows as
43	43	follows, to wit:
44	44	BEGINNING at a half-inch steel rod, capped and marked
45	45	"SOUTEX", found on the southeasterly line of a 225' wide Kansas City
46	46	Southern Railway Company right of way, formerly Texarkana & Fort
47	47	Smith Railway Company, and the West line of a (Called 496.00) acre
48	48	tract of land, known as Parcel 1, described in a deed to Optimus
49	49	Steel, LLC, recorded in File No. 458665, Official Public Records,
50	50	Orange County, Texas, for the most northerly corner of the herein
51	51	described tract; said capped rod having coordinates of N:
52	52	10052007.85, E: 4274200.44;
53	53	THENCE, South 05 deg., 58 min., 02 sec., East, on the West
54	54	line of the (Called 496.00) acre tract, a distance of 1894.32' to a
55	55	3" steel pipe found for corner on the common line of the Gilbert
56	56	Stevenson Survey, Abstract No. 167 and the William Stephenson
57	57	Survey, Abstract No. 23; said steel pipe having coordinates of N:
58	58	10050123.79, E: 4274397.37;
59	59	THENCE, South 06 deg., 06 min., 36 sec., East, continuing on
60	60	the West line of the (Called 496.00) acre tract, and an extension
61	61	thereof, at 2271.95' passing a 1" steel pipe found for reference,
62	62	and continuing a total distance of 2729.68'± to a point on the
63	63	thread of the Neches River, for the Southeast corner of the herein
64	64	described tract; said point for corner being on the current
65	65	boundary of the Port of Beaumont Navigation District;
66	66	THENCE, in a northwesterly direction, on the thread of the
67	67	Neches River and the current limits of the Port of Beaumont
68	68	Navigation District, a distance of 5143'± to a point on the
69	69	southeasterly line of the 225' wide Kansas City Southern Railway
70	70	Company right of way, for the Southwest corner of the herein
71	71	described tract;
72	72	THENCE, North 45 deg. 36 min. 40 sec East, on the
73	73	southeasterly line of said Kansas City Southern Railway Company
74	74	right of way, a distance of 386.45'± to a point for corner;
75	75	THENCE, continuing on the southeasterly line of said Kansas
76	76	City Southern Railway Company right of way, on the arc of a curve to
77	77	the right, having a radius of 2785.00', an arc length of 477.92', a
78	78	chord bearing of North 50 deg., 07 min., 07 sec., East, a chord
79	79	distance of 477.33' to a point for corner;
80	80	THENCE, North 55 deg., 02 min., 05 sec., East, continuing on
81	81	the southeasterly line of said Kansas City Southern Railway right
82	82	of way, a distance of 4430.21' to the POINT OF BEGINNING and
83	83	containing 265.4 ± acres of land and water, more or less.
84	84	SECTION 3. This Act takes effect immediately if it receives
85	85	a vote of two-thirds of all the members elected to each house, as
86	86	provided by Section 39, Article III, Texas Constitution. If this
87	87	Act does not receive the vote necessary for immediate effect, this
88	88	Act takes effect September 1, 2021.
