8 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 16 | | SECTION 1. Subtitle C, Title 6, Special District Local Laws |
---|
10 | 17 | | Code, is amended by adding Chapter 7220 to read as follows: |

11 | 18 | | CHAPTER 7220. HIGH POINT SPECIAL UTILITY DISTRICT OF KAUFMAN AND |

12 | 19 | | ROCKWALL COUNTIES |

13 | 20 | | SUBCHAPTER A. GENERAL PROVISIONS |

14 | 21 | | Sec. 7220.0101. DEFINITIONS. In this chapter: |
---|
15 | 22 | | (1) "Board" means the board of directors of the |
---|
16 | 23 | | district. |
---|
17 | 24 | | (2) "Director" means a member of the board. |
---|
18 | 25 | | (3) "District" means the High Point Special Utility |
---|
19 | 26 | | District of Kaufman and Rockwall Counties. |

20 | 27 | | SUBCHAPTER B. BOARD OF DIRECTORS |
---|
21 | 28 | | Sec. 7220.0201. COMPOSITION OF BOARD. The district is |
---|
22 | 29 | | governed by a board of seven directors. |
---|
23 | 30 | | Sec. 7220.0202. ELECTION OF DIRECTORS FROM SINGLE-MEMBER |
---|
24 | 31 | | DISTRICTS. (a) The board by rule may provide for the election of |
---|
25 | 32 | | some or all of the directors from single-member districts. |
---|
26 | 33 | | (b) If the board provides for the election of some or all of |
---|
27 | 34 | | the directors from single-member districts, to be eligible to be |
---|
28 | 35 | | listed on the ballot as a candidate for or to serve as a director |
---|
29 | 36 | | from a single-member district, a person must be a resident of that |
---|
30 | 37 | | district. |
---|
31 | 38 | | SECTION 2. The change in law made by Section 7220.0202, |
---|
32 | 39 | | Special District Local Laws Code, as added by this Act, does not |
---|
33 | 40 | | affect the entitlement of a member serving on the board of directors |
---|
34 | 41 | | of the High Point Special Utility District of Kaufman and Rockwall |
---|
35 | 42 | | Counties immediately before the effective date of this Act to |
---|
36 | 43 | | continue to carry out the board's functions for the remainder of the |
---|
37 | 44 | | member's term. The change in law applies only to a member elected |
---|
38 | 45 | | on or after the effective date of this Act. This Act does not |
---|
39 | 46 | | prohibit a person who is a member of the board on the effective date |
---|
40 | 47 | | of this Act from being reelected to the board if the person has the |
---|
41 | 48 | | qualifications required for a member under Section 7220.0202, |
---|
42 | 49 | | Special District Local Laws Code, as added by this Act. |
---|
43 | 50 | | SECTION 3. (a) The legal notice of the intention to |
---|
44 | 51 | | introduce this Act, setting forth the general substance of this |
---|
45 | 52 | | Act, has been published as provided by law, and the notice and a |
---|
46 | 53 | | copy of this Act have been furnished to all persons, agencies, |
---|
47 | 54 | | officials, or entities to which they are required to be furnished |
---|
48 | 55 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
49 | 56 | | Government Code. |
---|
50 | 57 | | (b) The governor, one of the required recipients, has |
---|
51 | 58 | | submitted the notice and Act to the Texas Commission on |
---|
52 | 59 | | Environmental Quality. |
---|
53 | 60 | | (c) The Texas Commission on Environmental Quality has filed |
---|
54 | 61 | | its recommendations relating to this Act with the governor, the |
---|
55 | 62 | | lieutenant governor, and the speaker of the house of |
---|
56 | 63 | | representatives within the required time. |
---|
57 | 64 | | (d) All requirements of the constitution and laws of this |
---|
58 | 65 | | state and the rules and procedures of the legislature with respect |
---|
59 | 66 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
60 | 67 | | and accomplished. |
---|
61 | 68 | | SECTION 4. This Act takes effect September 1, 2021. |
