411 AN ACT
512 relating to the qualifications and method of electing directors of
613 the High Point Special Utility District of Kaufman and Rockwall
714 Counties.
815 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
916 SECTION 1. Subtitle C, Title 6, Special District Local Laws
1017 Code, is amended by adding Chapter 7220 to read as follows:
1118 CHAPTER 7220. HIGH POINT SPECIAL UTILITY DISTRICT OF KAUFMAN AND
1219 ROCKWALL COUNTIES
1320 SUBCHAPTER A. GENERAL PROVISIONS
1421 Sec. 7220.0101. DEFINITIONS. In this chapter:
1522 (1) "Board" means the board of directors of the
1623 district.
1724 (2) "Director" means a member of the board.
1825 (3) "District" means the High Point Special Utility
1926 District of Kaufman and Rockwall Counties.
2027 SUBCHAPTER B. BOARD OF DIRECTORS
2128 Sec. 7220.0201. COMPOSITION OF BOARD. The district is
2229 governed by a board of seven directors.
2330 Sec. 7220.0202. ELECTION OF DIRECTORS FROM SINGLE-MEMBER
2431 DISTRICTS. (a) The board by rule may provide for the election of
2532 some or all of the directors from single-member districts.
2633 (b) If the board provides for the election of some or all of
2734 the directors from single-member districts, to be eligible to be
2835 listed on the ballot as a candidate for or to serve as a director
2936 from a single-member district, a person must be a resident of that
3037 district.
3138 SECTION 2. The change in law made by Section 7220.0202,
3239 Special District Local Laws Code, as added by this Act, does not
3340 affect the entitlement of a member serving on the board of directors
3441 of the High Point Special Utility District of Kaufman and Rockwall
3542 Counties immediately before the effective date of this Act to
3643 continue to carry out the board's functions for the remainder of the
3744 member's term. The change in law applies only to a member elected
3845 on or after the effective date of this Act. This Act does not
3946 prohibit a person who is a member of the board on the effective date
4047 of this Act from being reelected to the board if the person has the
4148 qualifications required for a member under Section 7220.0202,
4249 Special District Local Laws Code, as added by this Act.
4350 SECTION 3. (a) The legal notice of the intention to
4451 introduce this Act, setting forth the general substance of this
4552 Act, has been published as provided by law, and the notice and a
4653 copy of this Act have been furnished to all persons, agencies,
4754 officials, or entities to which they are required to be furnished
4855 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4956 Government Code.
5057 (b) The governor, one of the required recipients, has
5158 submitted the notice and Act to the Texas Commission on
5259 Environmental Quality.
5360 (c) The Texas Commission on Environmental Quality has filed
5461 its recommendations relating to this Act with the governor, the
5562 lieutenant governor, and the speaker of the house of
5663 representatives within the required time.
5764 (d) All requirements of the constitution and laws of this
5865 state and the rules and procedures of the legislature with respect
5966 to the notice, introduction, and passage of this Act are fulfilled
6067 and accomplished.
6168 SECTION 4. This Act takes effect September 1, 2021.
