413 relating to the creation of the Veale Ranch Municipal Management
514 District No. 1; providing authority to issue bonds; providing
615 authority to impose assessments, fees, and taxes.
716 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
817 SECTION 1. Subtitle C, Title 4, Special District Local Laws
918 Code, is amended by adding Chapter 3994 to read as follows:
1019 CHAPTER 3994. VEALE RANCH MUNICIPAL MANAGEMENT DISTRICT NO. 1
1120 SUBCHAPTER A. GENERAL PROVISIONS
1221 Sec. 3994.0101. DEFINITIONS. In this chapter:
1322 (1) "Board" means the district's board of directors.
1423 (2) "City" means any municipality in the corporate
1524 limits or extraterritorial jurisdiction of which the district is
1625 located.
1726 (3) "County" means Parker County or Tarrant County.
1827 (4) "Director" means a board member.
1928 (5) "District" means the Veale Ranch Municipal
2029 Management District No. 1.
2130 Sec. 3994.0102. NATURE OF DISTRICT. The Veale Ranch
2231 Municipal Management District No. 1 is a special district created
2332 under Section 59, Article XVI, Texas Constitution.
2433 Sec. 3994.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2534 creation of the district is essential to accomplish the purposes of
2635 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2736 Texas Constitution, and other public purposes stated in this
2837 chapter.
2938 (b) By creating the district and in authorizing a county, a
3039 city, and other political subdivisions to contract with the
3140 district, the legislature has established a program to accomplish
3241 the public purposes set out in Section 52-a, Article III, Texas
3342 Constitution.
3443 (c) The creation of the district is necessary to promote,
3544 develop, encourage, and maintain employment, commerce,
3645 transportation, housing, tourism, recreation, the arts,
3746 entertainment, economic development, safety, and the public
3847 welfare in the district.
3948 (d) This chapter and the creation of the district may not be
4049 interpreted to relieve a county or city from providing the level of
4150 services provided as of the effective date of the Act enacting this
4251 chapter to the area in the district. The district is created to
4352 supplement and not to supplant county or city services provided in
4453 the district.
4554 Sec. 3994.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4655 (a) All land and other property included in the district will
4756 benefit from the improvements and services to be provided by the
4857 district under powers conferred by Sections 52 and 52-a, Article
4958 III, and Section 59, Article XVI, Texas Constitution, and other
5059 powers granted under this chapter.
5160 (b) The district is created to serve a public use and
5261 benefit.
5362 (c) The creation of the district is in the public interest
5463 and is essential to further the public purposes of:
5564 (1) developing and diversifying the economy of the
5665 state;
5766 (2) eliminating unemployment and underemployment; and
5867 (3) developing or expanding transportation and
5968 commerce.
6069 (d) The district will:
6170 (1) promote the health, safety, and general welfare of
6271 residents, employers, potential employees, employees, visitors,
6372 and consumers in the district, and of the public;
6473 (2) provide needed funding for the district to
6574 preserve, maintain, and enhance the economic health and vitality of
6675 the district territory as a community and business center;
6776 (3) promote the health, safety, welfare, and enjoyment
6877 of the public by providing pedestrian ways and by landscaping and
6978 developing certain areas in the district, which are necessary for
7079 the restoration, preservation, and enhancement of scenic beauty;
7180 and
7281 (4) provide for water, wastewater, drainage, road, and
7382 recreational facilities for the district.
7483 (e) Pedestrian ways along or across a street, whether at
7584 grade or above or below the surface, and street lighting, street
7685 landscaping, parking, and street art objects are parts of and
7786 necessary components of a street and are considered to be a street
7887 or road improvement.
7988 (f) The district will not act as the agent or
8089 instrumentality of any private interest even though the district
8190 will benefit many private interests as well as the public.
8291 Sec. 3994.0105. INITIAL DISTRICT TERRITORY. (a) The
8392 district is initially composed of the territory described by
8493 Section 2 of the Act enacting this chapter.
8594 (b) The boundaries and field notes contained in Section 2 of
8695 the Act enacting this chapter form a closure. A mistake in the
8796 field notes or in copying the field notes in the legislative process
8897 does not affect the district's:
8998 (1) organization, existence, or validity;
9099 (2) right to issue any type of bonds for the purposes
91100 for which the district is created or to pay the principal of and
92101 interest on the bonds;
93102 (3) right to impose or collect an assessment or tax; or
94103 (4) legality or operation.
95104 Sec. 3994.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
96105 (a) All or any part of the area of the district is eligible to be
97106 included in:
98107 (1) a tax increment reinvestment zone created under
99108 Chapter 311, Tax Code;
100109 (2) a tax abatement reinvestment zone created under
101110 Chapter 312, Tax Code; or
102111 (3) an enterprise zone created under Chapter 2303,
103112 Government Code.
104113 (b) If a city or county creates a tax increment reinvestment
105114 zone described by Subsection (a), the city or county and the board
106115 of directors of the zone, by contract with the district, may grant
107116 money deposited in the tax increment fund to the district to be used
108117 by the district for:
109118 (1) the purposes permitted for money granted to a
110119 corporation under Section 380.002(b), Local Government Code; and
111120 (2) any other district purpose, including the right to
112121 pledge the money as security for any bonds or other obligations
113122 issued by the district under Subchapter E.
114123 (c) If a city or county creates a tax increment reinvestment
115124 zone described by Subsection (a), the city or county may determine
116125 the percentage of the property in the zone that may be used for
117126 residential purposes and is not subject to the limitations provided
118127 by Section 311.006, Tax Code.
119128 Sec. 3994.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
120129 DISTRICTS LAW. Except as otherwise provided by this chapter,
121130 Chapter 375, Local Government Code, applies to the district.
122131 Sec. 3994.0108. CONSTRUCTION OF CHAPTER. This chapter
123132 shall be liberally construed in conformity with the findings and
124133 purposes stated in this chapter.
125134 SUBCHAPTER B. BOARD OF DIRECTORS
126135 Sec. 3994.0201. GOVERNING BODY; TERMS. (a) The district is
127136 governed by a board of five elected directors who serve staggered
128137 terms of four years.
129138 (b) Directors are elected in the manner provided by
130139 Subchapter D, Chapter 49, Water Code.
131140 Sec. 3994.0202. COMPENSATION; EXPENSES. (a) The district
132141 may compensate each director in an amount not to exceed $150 for
133142 each board meeting. The total amount of compensation for each
134143 director in one year may not exceed $7,200.
135144 (b) A director is entitled to reimbursement for necessary
136145 and reasonable expenses incurred in carrying out the duties and
137146 responsibilities of the board.
138147 Sec. 3994.0203. INITIAL DIRECTORS. (a) The initial board
139148 consists of the following directors:

156165 SUBCHAPTER C. POWERS AND DUTIES
157166 Sec. 3994.0301. GENERAL POWERS AND DUTIES. The district
158167 has the powers and duties necessary to accomplish the purposes for
159168 which the district is created.
160169 Sec. 3994.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
161170 district, using any money available to the district for the
162171 purpose, may provide, design, construct, acquire, improve,
163172 relocate, operate, maintain, or finance an improvement project or
164173 service authorized under this chapter or Chapter 375, Local
165174 Government Code.
166175 (b) The district may contract with a governmental or private
167176 entity to carry out an action under Subsection (a).
168177 (c) The implementation of a district project or service is a
169178 governmental function or service for the purposes of Chapter 791,
170179 Government Code.
171180 Sec. 3994.0303. NONPROFIT CORPORATION. (a) The board by
172181 resolution may authorize the creation of a nonprofit corporation to
173182 assist and act for the district in implementing a project or
174183 providing a service authorized by this chapter.
175184 (b) The nonprofit corporation:
176185 (1) has each power of and is considered to be a local
177186 government corporation created under Subchapter D, Chapter 431,
178187 Transportation Code; and
179188 (2) may implement any project and provide any service
180189 authorized by this chapter.
181190 (c) The board shall appoint the board of directors of the
182191 nonprofit corporation. The board of directors of the nonprofit
183192 corporation shall serve in the same manner as the board of directors
184193 of a local government corporation created under Subchapter D,
185194 Chapter 431, Transportation Code, except that a board member is not
186195 required to reside in the district.
187196 Sec. 3994.0304. LAW ENFORCEMENT SERVICES. To protect the
188197 public interest, the district may contract with a county or city to
189198 provide additional law enforcement services in the district for a
190199 fee.
191200 Sec. 3994.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
192201 The district may join and pay dues to a charitable or nonprofit
193202 organization that performs a service or provides an activity
194203 consistent with the furtherance of a district purpose.
195204 Sec. 3994.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
196205 district may engage in activities that accomplish the economic
197206 development purposes of the district.
198207 (b) The district may establish and provide for the
199208 administration of one or more programs to promote state or local
200209 economic development and to stimulate business and commercial
201210 activity in the district, including programs to:
202211 (1) make loans and grants of public money; and
203212 (2) provide district personnel and services.
204213 (c) The district may create economic development programs
205214 and exercise the economic development powers provided to
206215 municipalities by:
207216 (1) Chapter 380, Local Government Code; and
208217 (2) Subchapter A, Chapter 1509, Government Code.
209218 Sec. 3994.0307. PARKING FACILITIES. (a) The district may
210219 acquire, lease as lessor or lessee, construct, develop, own,
211220 operate, and maintain parking facilities or a system of parking
212221 facilities, including lots, garages, parking terminals, or other
213222 structures or accommodations for parking motor vehicles off the
214223 streets and related appurtenances.
215224 (b) The district's parking facilities serve the public
216225 purposes of the district and are owned, used, and held for a public
217226 purpose even if leased or operated by a private entity for a term of
218227 years.
219228 (c) The district's parking facilities are parts of and
220229 necessary components of a street and are considered to be a street
221230 or road improvement.
222231 (d) The development and operation of the district's parking
223232 facilities may be considered an economic development program.
224233 Sec. 3994.0308. ADDING OR EXCLUDING LAND. The district may
225234 add or exclude land in the manner provided by Subchapter J, Chapter
226235 49, Water Code, or by Subchapter H, Chapter 54, Water Code.
227236 Sec. 3994.0309. DISBURSEMENTS AND TRANSFERS OF MONEY. The
228237 board by resolution shall establish the number of directors'
229238 signatures and the procedure required for a disbursement or
230239 transfer of district money.
231240 Sec. 3994.0310. NO EMINENT DOMAIN POWER. The district may
232241 not exercise the power of eminent domain.
233242 Sec. 3994.0311. DIVISION OF DISTRICT. (a) The district may
234243 be divided into two or more new districts only if the district:
235244 (1) has no outstanding bonded debt; and
236245 (2) is not imposing ad valorem taxes.
237246 (b) This chapter applies to any new district created by the
238247 division of the district, and a new district has all the powers and
239248 duties of the district.
240249 (c) Any new district created by the division of the district
241250 may not, at the time the new district is created, contain any land
242251 outside the area described by Section 2 of the Act enacting this
243252 chapter.
244253 (d) The board, on its own motion or on receipt of a petition
245254 signed by the owner or owners of a majority of the assessed value of
246255 the real property in the district, may adopt an order dividing the
247256 district.
248257 (e) An order dividing the district must:
249258 (1) name each new district;
250259 (2) include the metes and bounds description of the
251260 territory of each new district;
252261 (3) appoint initial directors for each new district;
253262 and
254263 (4) provide for the division of assets and liabilities
255264 between or among the new districts.
256265 (f) On or before the 30th day after the date of adoption of
257266 an order dividing the district, the district shall file the order
258267 with the Texas Commission on Environmental Quality and record the
259268 order in the real property records of each county in which the
260269 district is located.
261270 (g) Any new district created by the division of the district
262271 must hold an election as required by this chapter to obtain voter
263272 approval before the district may impose a maintenance tax or issue
264273 bonds payable wholly or partly from ad valorem taxes.
265274 (h) Municipal consent to the creation of the district and to
266275 the inclusion of land in the district granted under Section
267276 3994.0506 acts as municipal consent to the creation of any new
268277 district created by the division of the district and to the
269278 inclusion of land in the new district.
270279 SUBCHAPTER D. ASSESSMENTS
271280 Sec. 3994.0401. PETITION REQUIRED FOR FINANCING SERVICES
272281 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
273282 service or improvement project with assessments under this chapter
274283 unless a written petition requesting that service or improvement
275284 has been filed with the board.
276285 (b) A petition filed under Subsection (a) must be signed by
277286 the owners of a majority of the assessed value of real property in
278287 the district subject to assessment according to the most recent
279288 certified tax appraisal roll for the county.
280289 Sec. 3994.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
281290 The board by resolution may impose and collect an assessment for any
282291 purpose authorized by this chapter in all or any part of the
283292 district.
284293 (b) An assessment, a reassessment, or an assessment
285294 resulting from an addition to or correction of the assessment roll
286295 by the district, penalties and interest on an assessment or
287296 reassessment, an expense of collection, and reasonable attorney's
288297 fees incurred by the district:
289298 (1) are a first and prior lien against the property
290299 assessed;
291300 (2) are superior to any other lien or claim other than
292301 a lien or claim for county, school district, or municipal ad valorem
293302 taxes; and
294303 (3) are the personal liability of and a charge against
295304 the owners of the property even if the owners are not named in the
296305 assessment proceedings.
297306 (c) The lien is effective from the date of the board's
298307 resolution imposing the assessment until the date the assessment is
299308 paid. The board may enforce the lien in the same manner that the
300309 board may enforce an ad valorem tax lien against real property.
301310 (d) The board may make a correction to or deletion from the
302311 assessment roll that does not increase the amount of assessment of
303312 any parcel of land without providing notice and holding a hearing in
304313 the manner required for additional assessments.
305314 SUBCHAPTER E. TAXES AND BONDS
306315 Sec. 3994.0501. TAX ELECTION REQUIRED. (a) The district
307316 must hold an election in the manner provided by Chapter 49, Water
308317 Code, or, if applicable, Chapter 375, Local Government Code, to
309318 obtain voter approval before the district may impose an ad valorem
310319 tax.
311320 (b) Section 375.243, Local Government Code, does not apply to
312321 the district.
313322 Sec. 3994.0502. OPERATION AND MAINTENANCE TAX. (a) If
314323 authorized by a majority of the district voters voting at an
315324 election under Section 3994.0501, the district may impose an
316325 operation and maintenance tax on taxable property in the district
317326 in the manner provided by Section 49.107, Water Code, for any
318327 district purpose, including to:
319328 (1) maintain and operate the district;
320329 (2) construct or acquire improvements; or
321330 (3) provide a service.
322331 (b) The board shall determine the operation and maintenance
323332 tax rate. The rate may not exceed the rate approved at the
324333 election.
325334 Sec. 3994.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
326335 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
327336 terms determined by the board.
328337 (b) The district may issue bonds, notes, or other
329338 obligations payable wholly or partly from ad valorem taxes,
330339 assessments, impact fees, revenue, contract payments, grants, or
331340 other district money, or any combination of those sources of money,
332341 to pay for any authorized district purpose.
333342 (c) The limitation on the outstanding principal amount of
334343 bonds, notes, or other obligations provided by Section 49.4645,
335344 Water Code, does not apply to the district.
336345 Sec. 3994.0504. BONDS SECURED BY REVENUE OR CONTRACT
337346 PAYMENTS. The district may issue, without an election, bonds
338347 secured by:
339348 (1) revenue other than ad valorem taxes, including
340349 contract revenues; or
341350 (2) contract payments, provided that the requirements
342351 of Section 49.108, Water Code, have been met.
343352 Sec. 3994.0505. BONDS SECURED BY AD VALOREM TAXES;
344353 ELECTIONS. (a) If authorized at an election under Section
345354 3994.0501, the district may issue bonds payable from ad valorem
346355 taxes.
347356 (b) At the time the district issues bonds payable wholly or
348357 partly from ad valorem taxes, the board shall provide for the annual
349358 imposition of a continuing direct annual ad valorem tax, without
350359 limit as to rate or amount, for each year that all or part of the
351360 bonds are outstanding as required and in the manner provided by
352361 Sections 54.601 and 54.602, Water Code.
353362 (c) All or any part of any facilities or improvements that
354363 may be acquired by a district by the issuance of its bonds may be
355364 submitted as a single proposition or as several propositions to be
356365 voted on at the election.
357366 Sec. 3994.0506. CONSENT OF MUNICIPALITY AND DEVELOPMENT
358367 AGREEMENT REQUIRED. (a) The board may not hold an election to
359368 authorize the issuance of bonds until:
360369 (1) the governing body of a city by ordinance or
361370 resolution consents to the creation of the district and to the
362371 inclusion of land in the district; and
363372 (2) the district, the governing body of the city that
364373 consents to the creation of the district as described by
365374 Subdivision (1), and the owner or owners of a majority of the
366375 assessed value of real property in the district negotiate and
367376 execute a mutually approved and accepted development and operating
368377 agreement, including any limitations imposed by the city.
369378 (b) A city's consent under Subsection (a) must be granted in
370379 the manner provided by Section 54.016, Water Code, for including
371380 land within the corporate limits or extraterritorial jurisdiction
372381 of a city.
373382 SUBCHAPTER I. DISSOLUTION
374383 Sec. 3994.0901. DISSOLUTION. (a) The board shall dissolve
375384 the district on written petition filed with the board by the owners
376385 of:
377386 (1) 66 percent or more of the assessed value of the
378387 property subject to assessment by the district based on the most
379388 recent certified county property tax rolls; or
380389 (2) 66 percent or more of the surface area of the
381390 district, excluding roads, streets, highways, utility
382391 rights-of-way, other public areas, and other property exempt from
383392 assessment by the district according to the most recent certified
384393 county property tax rolls.
385394 (b) The board by majority vote may dissolve the district at
386395 any time.
387396 (c) The district may not be dissolved by its board under
388397 Subsection (a) or (b) if the district:
389398 (1) has any outstanding bonded indebtedness until that
390399 bonded indebtedness has been repaid or defeased in accordance with
391400 the order or resolution authorizing the issuance of the bonds;
392401 (2) has a contractual obligation to pay money until
393402 that obligation has been fully paid in accordance with the
394403 contract; or
395404 (3) owns, operates, or maintains public works,
396405 facilities, or improvements unless the district contracts with
397406 another person for the ownership, operation, or maintenance of the
398407 public works, facilities, or improvements.
399408 (d) Sections 375.261, 375.262, and 375.264, Local
400409 Government Code, do not apply to the district.
401410 SECTION 2. The Veale Ranch Municipal Management District
402411 No. 1 initially includes all territory contained in the following
403412 area:
404413 All that certain 3790.36 acre tract or parcel of land situated in
405414 Tarrant and Parker Counties of the State of Texas and being part of
406415 the H. T. & B. RR Co. Survey, Section Number 3, Abstract Number 648,
407416 the N. Underwood Survey, Abstract Number 1579, the I. & G. N. RR Co.
408417 Survey, Abstract Number 2002, the W. Robinson Survey, Abstract
409418 Number 1107, the I. & G. N. RR Co. Survey, Abstract Number 2224, the
410419 I & G. N. RR Co. Survey, Abstract Number 1991, in said Parker
411420 County; and being part of the I. & G. N. RR Co. Survey, Abstract
412421 Number not yet assigned this date, the I & G. N. RR Co. Survey,
413422 Abstract Number not yet assigned this date, the W. Robinson Survey,
414423 Abstract Number 1274, the H. Lane Survey, Abstract Number 928, the
415424 T. & N. O. RR Survey, Abstract Number 1567, the S. A. & M. G. RR Co.
416425 Survey, Abstract Number 1479, the Socorro Farming Co. Survey,
417426 Abstract Number 1844, the G. H. & H. RR Survey, Abstract Number 623,
418427 the D. Dixon Survey, Abstract Number 442, the D. T. Finley Survey,
419428 Abstract Number 1900, the D. T. Finley Survey, Abstract Number
420429 1903, and all of the W. Atkins Survey, Abstract Number 1961 in said
421430 Tarrant County, said tract being part of a called 3893.555 acre
422431 tract as described in a deed to Iona L.L.C., filed 24 April 2003,
423432 and recorded in volume 2096 page 106 of the Official Property
424433 Records of said Parker County, Texas, (hereinafter referred to as
425434 OPRPC), and recorded in instrument D203145633 of the Official
426435 Records of said Tarrant County (hereinafter referred to as ORTC),
427436 and said tract being all of a called 11.000 acre tract as described
428437 in deed to Iona Land, L.P., filed 03 May 2005, and recorded in
429438 instrument number D205124001, and said tract being all of the
430439 remainder of a called 62.050 acre tract of land and all of a called
431440 0.847 acre tract of land as described in a deed to Iona East L.L.C.,
432441 filed 21 April 2015, recorded in Document Number 215081241 of said
433442 ORTC, said tract also being all of a called 25.00 acre tract as
434443 described in a deed to Iona East L.L.C., filed 21 April 2015,
435444 recorded in Document Number 215081239 of said ORTC, and being more
436445 particularly described as follows;
437446 BEGINNING at a nail found at the base of a pipe fence corner post for
438447 the most southerly southeast corner of the tract being described,
439448 said nail having NAD83 Grid coordinates of N-6918724.96,
440449 E-2268232.52, and said nail being the most southerly southeast
441450 corner of said Iona 3893.555 acre tract, same being the northeast
442451 corner of a called 584.049 acre tract of land to Aledo Real Estate
443452 Landholdings Group LLC, filed 30 May 2007, recorded in Document
444453 Number 207185948 of said ORTC, said nail also being on the west line
445454 of a called 1214.617 acre tract of land as described in a deed to
446455 Johnny Hampton (Bud) Vinson II and Cheryl R. Vinson, filed 24 May
447456 2004, recorded in Document Number 204159103 of said ORTC;
448457 THENCE: South 89 degrees 26 minutes 17 seconds West, with the south
449458 line of said Iona 3893.555 acre tract and the north line of said
450459 Aledo tract, and along and near a barbed wire fence, a distance of
451460 5820.74 feet to a found 1/2 inch iron rod for the most southerly
452461 southwest corner of said Iona 3893.555 acre tract, same being the
453462 northwest corner of the Bella Flora, an Addition to said Tarrant
454463 County, according to plat of the same authorized 12 November 2013,
455464 and recorded in document number D213294652 of the Plat Records of
456465 said Tarrant County, and said rod being in the east line of a called
457466 231-522/100 acre tract of land as described in a deed to Forest C.
458467 Barber, Jr., filed 12 November 2004, recorded in Document Number
459468 204353915 of said ORTC;
460469 THENCE: North 00 degrees 33 minutes 10 seconds West, with the west

835844 (c) The Texas Commission on Environmental Quality has filed
836845 its recommendations relating to this Act with the governor,
837846 lieutenant governor, and speaker of the house of representatives
838847 within the required time.
839848 (d) All requirements of the constitution and laws of this
840849 state and the rules and procedures of the legislature with respect
841850 to the notice, introduction, and passage of this Act have been
842851 fulfilled and accomplished.
843852 SECTION 4. This Act takes effect immediately if it receives
844853 a vote of two-thirds of all the members elected to each house, as
845854 provided by Section 39, Article III, Texas Constitution. If this
846855 Act does not receive the vote necessary for immediate effect, this
847856 Act takes effect September 1, 2021.
