55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of an additional county court at law in
88 McLennan County and the operation of the county courts at law in
99 that county.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 25.1571, Government Code, is amended to
1212 read as follows:
1313 Sec. 25.1571. MCLENNAN COUNTY. McLennan County has the
1414 following statutory county courts:
1515 (1) County Court at Law of McLennan County; [and]
1616 (2) County Court at Law No. 2 of McLennan County; and
1717 (3) County Court at Law No. 3 of McLennan County.
1818 SECTION 2. Section 25.1572, Government Code, is amended by
1919 amending Subsections (a), (d), and (i) and adding Subsection (e) to
2020 read as follows:
2121 (a) In addition to the jurisdiction provided by Section
2222 25.0003 and other law, a county court at law in McLennan County has:
2323 (1) concurrent jurisdiction with the district court in
2424 state jail, third degree, and second degree felony cases on
2525 assignment from a district judge presiding in McLennan County and
2626 acceptance of the assignment by the judge of the county court at law
2727 [and jurisdiction] to:
2828 (A) conduct arraignments;
2929 (B) [,] conduct pretrial hearings;
3030 (C) [,] accept guilty pleas and conduct
3131 sentencing;
3232 (D) conduct jury trials and nonjury trials;
3333 (E) [, and] conduct probation revocation
3434 hearings; and
3535 (F) conduct post-trial proceedings; and
3636 (2) jurisdiction in:
3737 (A) Class A and Class B misdemeanor cases;
3838 (B) probate proceedings;
3939 (C) disputes ancillary to probate, eminent
4040 domain, condemnation, or landlord and tenant matters relating to
4141 the adjudication and determination of land titles and trusts,
4242 whether testamentary, inter vivos, constructive, resulting, or any
4343 other class or type of trust, regardless of the amount in
4444 controversy or the remedy sought; and
4545 (D) appeals from the justice and municipal courts
4646 [in felony cases].
4747 (d) A judge of a county court at law shall be paid a total
4848 [an] annual salary set by the commissioners court in an amount that
4949 is not less than $1,000 less than the annual salary received by a
5050 district judge with equivalent years of service as a judge, as
5151 provided under Section 25.0005, to be paid out of the county
5252 treasury by the commissioners court [of not more than $20,000. Each
5353 judge receives the same amount as salary. The salary shall be paid
5454 out of the county treasury by the commissioners court].
5555 (e) The district clerk serves as clerk of a county court at
5656 law in matters of concurrent jurisdiction with the district court,
5757 and the county clerk serves as clerk of a county court at law in all
5858 other matters. Each clerk shall establish a separate docket for a
5959 county court at law.
6060 (i) The official court reporter of a county court at law is
6161 entitled to receive the same compensation and to be paid in the same
6262 manner as the court reporters of the district courts in McLennan
6363 County.
6464 SECTION 3. The County Court at Law No. 3 of McLennan County
6565 is created on the effective date of this Act.
6666 SECTION 4. This Act takes effect September 1, 2021.
