55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the authority for road projects of the Blaketree
88 Municipal Utility District No. 1 of Montgomery County; affecting
99 the authority to issue bonds.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 8316.103, Special District Local Laws
1212 Code, is amended to read as follows:
1313 Sec. 8316.103. AUTHORITY FOR ROAD PROJECTS. Under Section
1414 52, Article III, Texas Constitution, the district may design,
1515 acquire, construct, finance, issue bonds for, improve, operate,
1616 maintain, and convey to this state, a county, or a municipality for
1717 operation and maintenance macadamized, graveled, or paved roads, or
1818 improvements, including storm drainage, in aid of those roads,
1919 including roads within a gated community as defined by Section
2020 352.112, Local Government Code, provided that those roads are open
2121 and accessible to all owners of real property located in the
2222 district, all residents of the district, and the invitees of owners
2323 and residents of the district.
2424 SECTION 2. The Blaketree Municipal Utility District No. 1
2525 of Montgomery County retains all the rights, powers, privileges,
2626 authority, duties, and functions that it had before the effective
2727 date of this Act.
2828 SECTION 3. (a) The legal notice of the intention to
2929 introduce this Act, setting forth the general substance of this
3030 Act, has been published as provided by law, and the notice and a
3131 copy of this Act have been furnished to all persons, agencies,
3232 officials, or entities to which they are required to be furnished
3333 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
3434 Government Code.
3535 (b) The governor, one of the required recipients, has
3636 submitted the notice and Act to the Texas Commission on
3737 Environmental Quality.
3838 (c) The Texas Commission on Environmental Quality has filed
3939 its recommendations relating to this Act with the governor, the
4040 lieutenant governor, and the speaker of the house of
4141 representatives within the required time.
4242 (d) All requirements of the constitution and laws of this
4343 state and the rules and procedures of the legislature with respect
4444 to the notice, introduction, and passage of this Act are fulfilled
4545 and accomplished.
4646 SECTION 4. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2021.
