85 AN ACT
9- relating to food allergen awareness in food service establishments.
6+ relating to confirmation of a voter's residence by a voter
7+ registrar.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11- SECTION 1. This Act may be cited as the Sergio Lopez Food
12- Allergy Awareness Act.
13- SECTION 2. Chapter 437, Health and Safety Code, is amended
14- by adding Section 437.026 to read as follows:
15- Sec. 437.026. FOOD ALLERGEN AWARENESS. (a) A food service
16- establishment shall display a poster relating to food allergen
17- awareness in an area of the establishment accessible primarily to
18- food service employees of the establishment. The department shall:
19- (1) determine the form and content of the poster;
20- (2) post a sample poster on the department's Internet
21- website; and
22- (3) update the poster as necessary to ensure that the
23- poster contains current information about food allergens and
24- remains consistent with standards promulgated by the United States
25- Food and Drug Administration.
26- (b) A food service establishment may display the
27- information from the sample poster in lieu of the poster, provided
28- the information is presented and posted in a manner that is easily
29- readable by the establishment's food service employees in the
30- selected employee area.
31- (c) The poster or posted information must:
32- (1) state that a reaction to a food allergen is
33- potentially life-threatening; and
34- (2) include information regarding:
35- (A) the risk of an allergic reaction to a food
36- allergen;
37- (B) the major food allergens, including milk,
38- wheat, eggs, soy, crustacean shellfish, peanuts, tree nuts, and
39- fish;
40- (C) the proper methods and procedures for
41- checking ingredients in food items, including unexpected or hidden
42- ingredients;
43- (D) the importance of clear communication
44- between customers with food allergies and the establishment's staff
45- concerning food allergens; and
46- (E) methods for preventing cross-contact in food
47- preparation.
48- (d) The executive commissioner shall adopt rules necessary
49- to implement this section.
50- (e) This section does not create a private cause of action
51- or change any common law or statutory duty.
52- SECTION 3. Not later than December 1, 2021:
53- (1) the Department of State Health Services shall
54- determine the form and content of the poster and post the sample
55- poster on the department's Internet website as required by Section
56- 437.026, Health and Safety Code, as added by this Act; and
57- (2) the executive commissioner of the Health and Human
58- Services Commission shall adopt any rules necessary to implement
59- Section 437.026, Health and Safety Code, as added by this Act.
60- SECTION 4. Notwithstanding Section 437.026, Health and
61- Safety Code, as added by this Act, a food service establishment is
62- not required to comply with that section before January 1, 2022.
63- SECTION 5. This Act takes effect September 1, 2021.
9+ SECTION 1. Section 15.051(a), Election Code, is amended to
10+ read as follows:
11+ (a) If the registrar receives notice under Section 13.146,
12+ 14.023, 15.054, 16.0921, or 18.0681(d) or otherwise has reason to
13+ believe that a voter's current residence is different from that
14+ indicated on the registration records, the registrar shall deliver
15+ to the voter a written confirmation notice requesting confirmation
16+ of the voter's current residence.
17+ SECTION 2. Subchapter C, Chapter 15, Election Code, is
18+ amended by adding Section 15.054 to read as follows:
19+ Sec. 15.054. CONFIRMATION NOTICE AFTER EVIDENCE OF CHANGE
20+ OF RESIDENCE. (a) At least annually the registrar shall:
21+ (1) request from the United States Postal Service any
22+ available information, including information from the National
23+ Change of Address database, indicating address reclassifications
24+ or changes of address affecting the registered voters of the
25+ county; and
26+ (2) for each voter in the county who fails to vote in
27+ any election, submit an application for a ballot to be voted by mail
28+ under Chapter 84 or 101, or submit a change in voter registration
29+ under Chapter 13 or 15 for two years from the date of a general
30+ election for state and county officers, examine real property sales
31+ and other public records to determine whether the voter changed
32+ residence to a location outside the county.
33+ (b) If information obtained under Subsection (a) gives the
34+ registrar reason to believe a voter has changed the voter's
35+ residence to a location outside of the county, the registrar shall
36+ deliver a confirmation notice to the voter in accordance with
37+ Section 15.051.
38+ SECTION 3. This Act takes effect immediately if it receives
39+ a vote of two-thirds of all the members elected to each house, as
40+ provided by Section 39, Article III, Texas Constitution. If this
41+ Act does not receive the vote necessary for immediate effect, this
42+ Act takes effect September 1, 2021.
