55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criminal jurisdiction of magistrates appointed by
88 the Collin County Commissioners Court.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 4.01, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 4.01. WHAT COURTS HAVE CRIMINAL JURISDICTION. The
1313 following courts have jurisdiction in criminal actions:
1414 1. The Court of Criminal Appeals;
1515 2. Courts of appeals;
1616 3. The district courts;
1717 4. The criminal district courts;
1818 5. The magistrates appointed by the judges of the
1919 district courts of Bexar County, Dallas County, Tarrant County, or
2020 Travis County that give preference to criminal cases and the
2121 magistrates appointed by the judges of the criminal district courts
2222 of Dallas County or Tarrant County;
2323 6. The county courts;
2424 7. All county courts at law with criminal
2525 jurisdiction;
2626 8. County criminal courts;
2727 9. Justice courts;
2828 10. Municipal courts;
2929 11. The magistrates appointed by the judges of the
3030 district courts of Lubbock County; [and]
3131 12. The magistrates appointed by the El Paso Council
3232 of Judges; and
3333 13. The magistrates appointed by the Collin County
3434 Commissioners Court.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2021.
