7	7	relating to the powers, duties, territory, and governance of the
8	8	Westwood Magnolia Parkway Improvement District; creating a

10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Chapter 323, Acts of the 78th Legislature,
12	12	Regular Session, 2003, is amended by adding Section 4D to read as
13	13	follows:
14	14	Sec. 4D. ADDITIONAL DISTRICT TERRITORY. In addition to the

1020	1020	SECTION 4. Section 20, Chapter 323, Acts of the 78th

1028	1028	rule adopted under this section. An offense under this section is a
1029	1029	Class C misdemeanor.
1030	1030	(e) The county attorney, district attorney, or criminal
1031	1031	district attorney or an attorney retained by the board for this
1032	1032	purpose may bring an action to enjoin a violation of board rules.
1033	1033	(f) The board shall, once a week for two consecutive weeks,
1034	1034	publish a substantive statement of the rules and the penalty for
1035	1035	violating the rules in one or more newspapers with general
1036	1036	circulation in the area in which the district is located. The
1037	1037	substantive statement must be condensed as much as possible to
1038	1038	explain the purpose to be accomplished or the act forbidden by the
1039	1039	rules. The notice must advise that a person who violates a rule is
1040	1040	subject to a penalty and that the full text of the rules is on file
1041	1041	in the principal office of the district or on the district's
1042	1042	website.
1043	1043	(g) Notwithstanding another provision of this section, a
1044	1044	person may not be arrested or prosecuted for an offense under this
1045	1045	section before the date of the second publication required by
1046	1046	Subsection (f) of this section.
1047	1047	SECTION 5. Chapter 323, Acts of the 78th Legislature,
1048	1048	Regular Session, 2003, is amended by adding Section 23F to read as
1049	1049	follows:
1050	1050	Sec. 23F. TRAFFIC IMPROVEMENTS. (a) The district may enter
1051	1051	into an agreement with the Texas Department of Transportation in
1052	1052	the same manner as a municipality under Section 221.002,
1053	1053	Transportation Code.
1054	1054	(b) The district may exercise the powers of a local
1055	1055	authority under Chapter 544, Transportation Code.
1056	1056	SECTION 6. Section 25, Chapter 323, Acts of the 78th
1057	1057	Legislature, Regular Session, 2003, is amended by adding Subsection
1058	1058	(a-1) to read as follows:
1059	1059	(a-1) The board may select the municipality that may
1060	1060	exercise authority in the district in the same manner that a
1061	1061	municipal utility district may select a municipality under Section
1062	1062	54.0163, Water Code.
1063	1063	SECTION 7. Section 29, Chapter 323, Acts of the 78th
1064	1064	Legislature, Regular Session, 2003, is amended by amending
1065	1065	Subsection (b) and adding Subsection (c) to read as follows:
1066	1066	(b) Payment for an improvement project, facility, service,
1067	1067	or equipment agreed to under this section may be made or pledged by
1068	1068	a local government [municipality] to the district out of any money
1069	1069	the local government [municipality] collects under Chapter 351, Tax
1070	1070	Code, or out of any other available money.
1071	1071	(c) An interlocal agreement of the district may not conflict
1072	1072	with Chapter 43, Local Government Code.
1073	1073	SECTION 8. Chapter 323, Acts of the 78th Legislature,
1074	1074	Regular Session, 2003, is amended by adding Section 29A to read as
1075	1075	follows:
1076	1076	Sec. 29A. STRATEGIC PARTNERSHIP AGREEMENTS. (a) The
1077	1077	district may enter into a strategic partnership agreement as
1078	1078	provided by Section 43.0751, Local Government Code, with a district
1079	1079	defined by that section.
1080	1080	(b) For the purposes of this section, a reference in Section
1081	1081	43.0751, Local Government Code, to a municipality means the
1082	1082	district.
1083	1083	(c) If the district enters into an agreement under this
1084	1084	section to annex territory for a limited purpose, the district
1085	1085	shall annex the territory in the manner provided by Section 25 of
1086	1086	this Act.
1087	1087	(d) Section 375.282, Local Government Code, does not apply
1088	1088	to the district.
1089	1089	SECTION 9. (a) The changes in law made by this Act do not
1090	1090	affect the entitlement of a member serving on the board of directors
1091	1091	of the Westwood Magnolia Parkway Improvement District immediately
1092	1092	before the effective date of this Act to continue to serve for the
1093	1093	remainder of the member's term.
1094	1094	(b) The changes in law made by this Act apply only to a
1095	1095	strategic partnership agreement entered into or renewed by the
1096	1096	Westwood Magnolia Parkway Improvement District on or after the
1097	1097	effective date of this Act. A strategic partnership agreement
1098	1098	entered into or renewed by the Westwood Magnolia Parkway
1099	1099	Improvement District before the effective date of this Act is
1100	1100	governed by the law as it existed immediately before the effective
1101	1101	date of this Act, and that law is continued in effect for that
1102	1102	purpose.
1103	1103	SECTION 10. (a) The legal notice of the intention to
1104	1104	introduce this Act, setting forth the general substance of this
1105	1105	Act, has been published as provided by law, and the notice and a
1106	1106	copy of this Act have been furnished to all persons, agencies,
1107	1107	officials, or entities to which they are required to be furnished
1108	1108	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
1109	1109	Government Code.
1110	1110	(b) The governor, one of the required recipients, has
1111	1111	submitted the notice and Act to the Texas Commission on
1112	1112	Environmental Quality.
1113	1113	(c) The Texas Commission on Environmental Quality has filed
1114	1114	its recommendations relating to this Act with the governor, the
1115	1115	lieutenant governor, and the speaker of the house of
1116	1116	representatives within the required time.
1117	1117	(d) All requirements of the constitution and laws of this
1118	1118	state and the rules and procedures of the legislature with respect
1119	1119	to the notice, introduction, and passage of this Act are fulfilled
1120	1120	and accomplished.
1121	1121	SECTION 11. This Act takes effect September 1, 2021.
