411 AN ACT
512 relating to the creation of the East Central Travis County
613 Conservation and Reclamation District No. 1; providing authority to
714 issue bonds; providing authority to impose assessments, fees, and
815 taxes.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1118 Code, is amended by adding Chapter 7953A to read as follows:
1219 CHAPTER 7953A. EAST CENTRAL TRAVIS COUNTY CONSERVATION AND
1320 RECLAMATION DISTRICT NO. 1
1421 SUBCHAPTER A. GENERAL PROVISIONS
1522 Sec. 7953A.0101. DEFINITIONS. In this chapter:
1623 (1) "Board" means the district's board of directors.
1724 (2) "Commission" means the Texas Commission on
1825 Environmental Quality.
1926 (3) "Director" means a board member.
2027 (4) "District" means the East Central Travis County
2128 Conservation and Reclamation District No. 1.
2229 Sec. 7953A.0102. NATURE OF DISTRICT. The district is a
2330 municipal utility district created under Section 59, Article XVI,
2431 Texas Constitution.
2532 Sec. 7953A.0103. CONFIRMATION AND DIRECTOR ELECTION
2633 REQUIRED. The temporary directors shall hold an election to
2734 confirm the creation of the district and to elect five permanent
2835 directors as provided by Section 49.102, Water Code.
2936 Sec. 7953A.0104. CONSENT OF MUNICIPALITY REQUIRED. The
3037 temporary directors may not hold an election under Section
3138 7953A.0103 until each municipality in whose corporate limits or
3239 extraterritorial jurisdiction the district is located has
3340 consented by ordinance or resolution to the creation of the
3441 district and to the inclusion of land in the district.
3542 Sec. 7953A.0105. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3643 (a) The district is created to serve a public purpose and benefit.
3744 (b) The district is created to accomplish the purposes of:
3845 (1) a municipal utility district as provided by
3946 general law and Section 59, Article XVI, Texas Constitution; and
4047 (2) Section 52, Article III, Texas Constitution, that
4148 relate to the construction, acquisition, improvement, operation,
4249 or maintenance of macadamized, graveled, or paved roads, or
4350 improvements, including storm drainage, in aid of those roads.
4451 Sec. 7953A.0106. INITIAL DISTRICT TERRITORY. (a) The
4552 district is initially composed of the territory described by
4653 Section 2 of the Act enacting this chapter.
4754 (b) The boundaries and field notes contained in Section 2 of
4855 the Act enacting this chapter form a closure. A mistake made in the
4956 field notes or in copying the field notes in the legislative process
5057 does not affect the district's:
5158 (1) organization, existence, or validity;
5259 (2) right to issue any type of bond for the purposes
5360 for which the district is created or to pay the principal of and
5461 interest on a bond;
5562 (3) right to impose a tax; or
5663 (4) legality or operation.
5764 SUBCHAPTER B. BOARD OF DIRECTORS
5865 Sec. 7953A.0201. GOVERNING BODY; TERMS. (a) The district
5966 is governed by a board of five elected directors.
6067 (b) Except as provided by Section 7953A.0202, directors
6168 serve staggered four-year terms.
6269 Sec. 7953A.0202. TEMPORARY DIRECTORS. (a) On or after the
6370 effective date of the Act enacting this chapter, the owner or owners
6471 of a majority of the assessed value of the real property in the
6572 district may submit a petition to the commission requesting that
6673 the commission appoint as temporary directors the five persons
6774 named in the petition. The commission shall appoint as temporary
6875 directors the five persons named in the petition.
6976 (b) Temporary directors serve until the earlier of:
7077 (1) the date permanent directors are elected under
7178 Section 7953A.0103; or
7279 (2) the fourth anniversary of the effective date of
7380 the Act enacting this chapter.
7481 (c) If permanent directors have not been elected under
7582 Section 7953A.0103 and the terms of the temporary directors have
7683 expired, successor temporary directors shall be appointed or
7784 reappointed as provided by Subsection (d) to serve terms that
7885 expire on the earlier of:
7986 (1) the date permanent directors are elected under
8087 Section 7953A.0103; or
8188 (2) the fourth anniversary of the date of the
8289 appointment or reappointment.
8390 (d) If Subsection (c) applies, the owner or owners of a
8491 majority of the assessed value of the real property in the district
8592 may submit a petition to the commission requesting that the
8693 commission appoint as successor temporary directors the five
8794 persons named in the petition. The commission shall appoint as
8895 successor temporary directors the five persons named in the
8996 petition.
9097 SUBCHAPTER C. POWERS AND DUTIES
9198 Sec. 7953A.0301. GENERAL POWERS AND DUTIES. The district
9299 has the powers and duties necessary to accomplish the purposes for
93100 which the district is created.
94101 Sec. 7953A.0302. MUNICIPAL UTILITY DISTRICT POWERS AND
95102 DUTIES. The district has the powers and duties provided by the
96103 general law of this state, including Chapters 49 and 54, Water Code,
97104 applicable to municipal utility districts created under Section 59,
98105 Article XVI, Texas Constitution.
99106 Sec. 7953A.0303. AUTHORITY FOR ROAD PROJECTS. Under
100107 Section 52, Article III, Texas Constitution, the district may
101108 design, acquire, construct, finance, issue bonds for, improve,
102109 operate, maintain, and convey to this state, a county, or a
103110 municipality for operation and maintenance macadamized, graveled,
104111 or paved roads, or improvements, including storm drainage, in aid
105112 of those roads.
106113 Sec. 7953A.0304. ROAD STANDARDS AND REQUIREMENTS. (a) A
107114 road project must meet all applicable construction standards,
108115 zoning and subdivision requirements, and regulations of each
109116 municipality in whose corporate limits or extraterritorial
110117 jurisdiction the road project is located.
111118 (b) If a road project is not located in the corporate limits
112119 or extraterritorial jurisdiction of a municipality, the road
113120 project must meet all applicable construction standards,
114121 subdivision requirements, and regulations of each county in which
115122 the road project is located.
116123 (c) If the state will maintain and operate the road, the
117124 Texas Transportation Commission must approve the plans and
118125 specifications of the road project.
119126 Sec. 7953A.0305. COMPLIANCE WITH MUNICIPAL CONSENT
120127 ORDINANCE OR RESOLUTION. The district shall comply with all
121128 applicable requirements of any ordinance or resolution that is
122129 adopted under Section 54.016 or 54.0165, Water Code, and that
123130 consents to the creation of the district or to the inclusion of land
124131 in the district.
125132 Sec. 7953A.0306. DIVISION OF DISTRICT. (a) The district
126133 may be divided into two or more new districts only if the district:
127134 (1) has never issued any bonds; and
128135 (2) is not imposing ad valorem taxes.
129136 (b) This chapter applies to any new district created by the
130137 division of the district, and a new district has all the powers and
131138 duties of the district.
132139 (c) A new district created by the division of the district
133140 may not, at the time the new district is created, contain any land
134141 outside the area described by Section 2 of the Act enacting this
135142 chapter.
136143 (d) The board, on its own motion or on receipt of a petition
137144 signed by the owner or owners of a majority of the assessed value of
138145 the real property in the district, may adopt an order dividing the
139146 district.
140147 (e) The board may adopt an order dividing the district
141148 before or after the date the board holds an election under Section
142149 7953A.0103 to confirm the district's creation.
143150 (f) An order dividing the district shall:
144151 (1) name each new district;
145152 (2) include the metes and bounds description of the
146153 territory of each new district;
147154 (3) appoint temporary directors for each new district;
148155 and
149156 (4) provide for the division of assets and liabilities
150157 between the new districts.
151158 (g) On or before the 30th day after the date of adoption of
152159 an order dividing the district, the district shall file the order
153160 with the commission and record the order in the real property
154161 records of each county in which the district is located.
155162 (h) A new district created by the division of the district
156163 shall hold a confirmation and directors' election as required by
157164 Section 7953A.0103.
158165 (i) If the creation of the new district is confirmed, the
159166 new district shall provide the election date and results to the
160167 commission.
161168 (j) Any new district created by the division of the district
162169 must hold an election as required by this chapter to obtain voter
163170 approval before the district may impose a maintenance tax or issue
164171 bonds payable wholly or partly from ad valorem taxes.
165172 (k) Municipal consent to the creation of the district and to
166173 the inclusion of land in the district granted under Section
167174 7953A.0104 acts as municipal consent to the creation of any new
168175 district created by the division of the district and to the
169176 inclusion of land in the new district.
170177 Sec. 7953A.0307. NO EMINENT DOMAIN POWER. The district may
171178 not exercise the power of eminent domain.
172179 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
173180 Sec. 7953A.0401. ELECTIONS REGARDING TAXES OR BONDS. (a)
174181 The district may issue, without an election, bonds and other
175182 obligations secured by:
176183 (1) revenue other than ad valorem taxes; or
177184 (2) contract payments described by Section
178185 7953A.0403.
179186 (b) The district must hold an election in the manner
180187 provided by Chapters 49 and 54, Water Code, to obtain voter approval
181188 before the district may impose an ad valorem tax or issue bonds
182189 payable from ad valorem taxes.
183190 (c) The district may not issue bonds payable from ad valorem
184191 taxes to finance a road project unless the issuance is approved by a
185192 vote of a two-thirds majority of the district voters voting at an
186193 election held for that purpose.
187194 Sec. 7953A.0402. OPERATION AND MAINTENANCE TAX. (a) If
188195 authorized at an election held under Section 7953A.0401, the
189196 district may impose an operation and maintenance tax on taxable
190197 property in the district in accordance with Section 49.107, Water
191198 Code.
192199 (b) The board shall determine the tax rate. The rate may not
193200 exceed the rate approved at the election.
194201 Sec. 7953A.0403. CONTRACT TAXES. (a) In accordance with
195202 Section 49.108, Water Code, the district may impose a tax other than
196203 an operation and maintenance tax and use the revenue derived from
197204 the tax to make payments under a contract after the provisions of
198205 the contract have been approved by a majority of the district voters
199206 voting at an election held for that purpose.
200207 (b) A contract approved by the district voters may contain a
201208 provision stating that the contract may be modified or amended by
202209 the board without further voter approval.
203210 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
204211 Sec. 7953A.0501. AUTHORITY TO ISSUE BONDS AND OTHER
205212 OBLIGATIONS. The district may issue bonds or other obligations
206213 payable wholly or partly from ad valorem taxes, impact fees,
207214 revenue, contract payments, grants, or other district money, or any
208215 combination of those sources, to pay for any authorized district
209216 purpose.
210217 Sec. 7953A.0502. TAXES FOR BONDS. At the time the district
211218 issues bonds payable wholly or partly from ad valorem taxes, the
212219 board shall provide for the annual imposition of a continuing
213220 direct ad valorem tax, without limit as to rate or amount, while all
214221 or part of the bonds are outstanding as required and in the manner
215222 provided by Sections 54.601 and 54.602, Water Code.
216223 Sec. 7953A.0503. BONDS FOR ROAD PROJECTS. At the time of
217224 issuance, the total principal amount of bonds or other obligations
218225 issued or incurred to finance road projects and payable from ad
219226 valorem taxes may not exceed one-fourth of the assessed value of the
220227 real property in the district.
221228 SECTION 2. The East Central Travis County Conservation and
222229 Reclamation District No. 1 initially includes all the territory
223230 contained in the following area:
224231 "PARCEL 1" - (Northwest Tract)
225232 BEING A DESCRIPTION OF a 791.6381 acres (34,483,754 square
226233 foot) tract of land out of the Santiago del Valle Grant, Abstract
227234 No. 24, Travis County, Texas, and being a portion of a called 23.04
228235 acre tract and all of a called 9.18 acre tract, both conveyed to
229236 Thelma Bolm Yeates et al. in Volume 5000, Page 2364 of the Deed
230237 Records of Travis County, Texas (D.R.T.C.T.), save and except a
231238 called 3.647 acre tract (DESCRIBED AS TRACT TWO) conveyed to the
232239 City of Austin in Document No. 2007113005 of the Official Public
233240 Records of Travis County, Texas (O.P.R.T.C.T.), a PORTION of a
234241 called 11.095 acre tract (described as tract three) and a called
235242 232.59 acre tract (described as tract four), both conveyed to
236243 Fitzpatrick Bar X Ranch, L.P., in Document Nos. 2011023927,
237244 2011023928 and 2012046374 (O.P.R.T.C.T.), a portion of said 232.59
238245 acre tract also being described as a called 18.690 acre tract
239246 conveyed to Lake Pasture Ranch, LLC, in Document Nos. 2020032051
240247 and 2020032052 (O.P.R.T.C.T.), and being all of a called 96.38 acre
241248 tract conveyed to Lake Pasture Ranch, LLC, in Document Nos.
242249 2020032051 and 2020032052 (O.P.R.T.C.T.), and being all of a called
243250 241.77 acre tract and a 213.71 acre tract conveyed (as an interest)
244251 to Bailey Ranch Holdings, L.P., in Document No. 2005171964

877884 SECTION 3. (a) The legal notice of the intention to
878885 introduce this Act, setting forth the general substance of this
879886 Act, has been published as provided by law, and the notice and a
880887 copy of this Act have been furnished to all persons, agencies,
881888 officials, or entities to which they are required to be furnished
882889 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
883890 Government Code.
884891 (b) The governor, one of the required recipients, has
885892 submitted the notice and Act to the Texas Commission on
886893 Environmental Quality.
887894 (c) The Texas Commission on Environmental Quality has filed
888895 its recommendations relating to this Act with the governor, the
889896 lieutenant governor, and the speaker of the house of
890897 representatives within the required time.
891898 (d) All requirements of the constitution and laws of this
892899 state and the rules and procedures of the legislature with respect
893900 to the notice, introduction, and passage of this Act are fulfilled
894901 and accomplished.
895902 SECTION 4. This Act takes effect immediately if it receives
896903 a vote of two-thirds of all the members elected to each house, as
897904 provided by Section 39, Article III, Texas Constitution. If this
898905 Act does not receive the vote necessary for immediate effect, this
899906 Act takes effect September 1, 2021.
