44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to presumptive coverage for school district employees that
77 contract COVID-19.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 607.054, Government Code, is amended as
1010 follows:
1111 Sec. 607.054. TUBERCULOSIS, SARS-CoV-2, COVID-19, OR OTHER
1212 RESPIRATORY ILLNESS.
1313 (a) A firefighter, peace officer, or emergency medical
1414 technician who suffers from tuberculosis, or any other disease or
1515 illness of the lungs or respiratory tract that has a statistically
1616 positive correlation with service as a firefighter, peace officer,
1717 or emergency medical technician, that results in death or total or
1818 partial disability is presumed to have contracted the disease or
1919 illness during the course and scope of employment as a firefighter,
2020 peace officer, or emergency medical technician.
2121 (b) An employee of a school district who is diagnosed with
2222 the virus SARS-CoV-2 or with coronavirus disease 2019 (COVID-19) by
2323 a test approved by the Centers for Disease Control and Prevention
2424 that results in death or total or partial disability is presumed to
2525 have contracted the disease or illness during the course and scope
2626 of employment as an employee of a school district.
2727 SECTION 2. This Act takes effect immediately.
