| 7 | 7 | | relating to the issuance of a physician's license to an applicant |

| 8 | 8 | | licensed as a physician in another state. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 155, Occupations Code, is |
|---|
| 11 | 11 | | amended by adding Section 155.012 to read as follows: |
|---|
| 12 | 12 | | Sec. 155.012. ISSUANCE OF LICENSE TO PHYSICIAN LICENSED IN |
|---|
| 13 | 13 | | ANOTHER STATE. (a) Notwithstanding any other law, the board shall |
|---|
| 14 | 14 | | issue an unrestricted license under this chapter to an applicant |
|---|
| 15 | 15 | | who is licensed in good standing as a physician in another state and |
|---|
| 16 | 16 | | who satisfies the requirements of this section. |
|---|
| 17 | 17 | | (b) The board may not issue a license under this section to |
|---|
| 18 | 18 | | an applicant who: |
|---|
| 19 | 19 | | (1) has had a medical license suspended or revoked by |
|---|
| 20 | 20 | | another state or a Canadian province; or |
|---|
| 21 | 21 | | (2) holds a medical license issued by another state or |
|---|
| 22 | 22 | | a Canadian province that is subject to a restriction, disciplinary |
|---|
| 23 | 23 | | order, or probationary order. |
|---|
| 24 | 24 | | (c) An applicant under this section must: |
|---|
| 25 | 25 | | (1) have passed a national or other examination |
|---|
| 26 | 26 | | recognized by the board relating to the practice of medicine within |
|---|
| 27 | 27 | | the number of attempts allowed under Section 155.056 or 155.0561, |
|---|
| 28 | 28 | | as applicable; and |
|---|
| 29 | 29 | | (2) submit information to enable the board to conduct |
|---|
| 30 | 30 | | a criminal background check as required by the board. |
|---|
| 31 | 31 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 32 | 32 | | to an applicant for a physician license who submits an application |
|---|
| 33 | 33 | | on or after January 1, 2022. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2021. |
