55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to services provided by freestanding emergency medical
88 care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 254.001, Health and Safety Code, is
1111 amended by amending Subdivisions (1) and (5) and adding
1212 Subdivisions (1-a) and (1-b) to read as follows:
1313 (1) "Acute care services" means outpatient medical
1414 services, including radiology services, laboratory services,
1515 immunization services, and other non-emergent physician services.
1616 (1-a) "Commission" means the Health and Human Services
1717 Commission.
1818 (1-b) "Department" means the commission [Department
1919 of State Health Services].
2020 (5) "Freestanding emergency medical care facility"
2121 means a facility, structurally separate and distinct from a
2222 hospital, that receives an individual and provides:
2323 (A) emergency care, as defined by Subdivision
2424 (2); and
2525 (B) acute care services, as defined by
2626 Subdivision (1).
2727 SECTION 2. Subchapter D, Chapter 254, Health and Safety
2828 Code, is amended by adding Section 254.1555 to read as follows:
2929 Sec. 254.1555. CERTAIN FEES PROHIBITED. A facility that
3030 provides acute care services may not charge an emergency facility
3131 fee for providing the services.
3232 SECTION 3. This Act takes effect September 1, 2021.
