66 AN ACT
77 relating to the conduct of primary elections.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 43.007(a), Election Code, is amended to
1010 read as follows:
1111 (a) The secretary of state shall implement a program to
1212 allow each commissioners court participating in the program to
1313 eliminate county election precinct polling places and establish
1414 countywide polling places for:
1515 (1) each general election for state and county
1616 officers;
1717 (2) each election held on the uniform election date in
1818 May and any resulting runoff;
1919 (3) each election on a proposed constitutional
2020 amendment;
2121 (4) each primary election and runoff primary election
2222 if[:
2323 [(A)] the county chair or county executive
2424 committee of each political party participating in a joint primary
2525 election under Section 172.126 agrees to the use of countywide
2626 polling places; [or
2727 [(B) the county chair or county executive
2828 committee of each political party required to nominate candidates
2929 by primary election agrees to use the same countywide polling
3030 places;] and
3131 (5) each election of a political subdivision located
3232 in the county that is held jointly with an election described by
3333 Subdivision (1), (2), (3), or (4).
3434 SECTION 2. The heading to Section 172.126, Election Code,
3535 is amended to read as follows:
3636 Sec. 172.126. JOINT PRIMARIES REQUIRED [AUTHORIZED].
3737 SECTION 3. Section 172.126(a), Election Code, is amended to
3838 read as follows:
3939 (a) The primary elections in a county shall [may] be
4040 conducted jointly at the regular polling places designated for the
4141 general election for state and county officers. The county clerk
4242 shall supervise the overall conduct of the joint primary elections.
4343 This section applies to the conduct of joint primary elections
4444 notwithstanding and in addition to other applicable provisions of
4545 this code. [The decision to conduct a joint general primary
4646 election or runoff primary election, as applicable, must be made by
4747 majority vote of the full membership of the commissioners court and
4848 with the unanimous approval of the county clerk and the county chair
4949 of each political party required to nominate candidates by primary
5050 election.]
5151 SECTION 4. Section 85.0091, Election Code, is repealed.
5252 SECTION 5. This Act takes effect September 1, 2021.
