55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing certain information to criminal defendants
88 before a plea is entered or before the defendant elects to have
99 punishment assessed by a jury.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 26.13, Code of Criminal Procedure, is
1212 amended by adding Subsection (j) to read as follows:
1313 (j) Before accepting a plea of guilty or a plea of nolo
1414 contendere for an offense punishable as a felony, the court shall
1515 admonish the defendant regarding:
1616 (1) the applicable provisions governing whether the
1717 judge or a jury will assess punishment in the case;
1818 (2) the range of punishments the judge or jury is
1919 authorized to consider; and
2020 (3) the effect of judge or jury sentencing on the
2121 eligibility of the defendant for:
2222 (A) judge-ordered community supervision under
2323 Article 42A.053;
2424 (B) jury-recommended community supervision under
2525 Article 42A.055; and
2626 (C) deferred adjudication community supervision
2727 under Subchapter C, Chapter 42A.
2828 SECTION 2. Chapter 28, Code of Criminal Procedure, is
2929 amended by adding Article 28.15 to read as follows:
3030 Art. 28.15. JURY SENTENCING. Before a defendant who is
3131 charged with an offense punishable as a felony files a sworn motion
3232 for community supervision as provided by Article 42A.055(b) or
3333 elects in writing to have punishment assessed by a jury, the court
3434 shall admonish the defendant regarding:
3535 (1) the range of punishments the judge or jury is
3636 authorized to consider; and
3737 (2) the effect of judge or jury sentencing on the
3838 eligibility of the defendant for:
3939 (A) judge-ordered community supervision under
4040 Article 42A.053;
4141 (B) jury-recommended community supervision under
4242 Article 42A.055; and
4343 (C) deferred adjudication community supervision
4444 under Subchapter C, Chapter 42A.
4545 SECTION 3. The changes in law made by this Act apply to a
4646 plea of guilty or nolo contendere entered or a motion or election
4747 for a jury to assess punishment made on or after the effective date
4848 of this Act, regardless of whether the offense with reference to
4949 which the plea is entered or motion or election is made is committed
5050 before, on, or after that date.
5151 SECTION 4. This Act takes effect September 1, 2021.
