55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a peace officer's duty to display and provide the
88 officer's name and identification number; creating a criminal
99 offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1212 amended by adding Article 2.1301 to read as follows:
1313 Art. 2.1301. DUTY TO DISPLAY AND PROVIDE NAME AND
1414 IDENTIFICATION NUMBER. (a) A peace officer who is discharging an
1515 official duty and is not undercover shall:
1616 (1) display in a visible manner at all times the
1717 officer's first and last name and badge number or other
1818 identification number; and
1919 (2) provide the officer's first and last name and badge
2020 number or other identification number to any person on request.
2121 (b) A peace officer wearing riot gear that includes a helmet
2222 or a shield is considered to have complied with Subsection (a)(1)
2323 only if the officer displays the required information on each of
2424 those items, as applicable.
2525 (c) A peace officer commits an offense if the officer
2626 violates Subsection (a)(2). An offense under this subsection is a
2727 Class C misdemeanor.
2828 SECTION 2. This Act takes effect September 1, 2021.
