10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
12 | 12 | amended by adding Article 2.1301 to read as follows: | |
13 | 13 | Art. 2.1301. DUTY TO DISPLAY AND PROVIDE NAME AND | |
14 | 14 | IDENTIFICATION NUMBER. (a) A peace officer who is discharging an | |
15 | 15 | official duty and is not undercover shall: | |
16 | 16 | (1) display in a visible manner at all times the | |
17 | 17 | officer's first and last name and badge number or other | |
18 | 18 | identification number; and | |
19 | 19 | (2) provide the officer's first and last name and badge | |
20 | 20 | number or other identification number to any person on request. | |
21 | 21 | (b) A peace officer wearing riot gear that includes a helmet | |
22 | 22 | or a shield is considered to have complied with Subsection (a)(1) | |
23 | 23 | only if the officer displays the required information on each of | |
24 | 24 | those items, as applicable. | |
25 | 25 | (c) A peace officer commits an offense if the officer | |
26 | 26 | violates Subsection (a)(2). An offense under this subsection is a | |
27 | 27 | Class C misdemeanor. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2021. |
