6	8		AN ACT
7	9		relating to the sale of fireworks on and before the Labor Day
8	10		holiday in certain counties.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Section 2154.202(g), Occupations Code, is
11	13		amended to read as follows:
12	14		(g) Except as provided by Subsection (h), a retail fireworks
13	15		permit holder may sell fireworks only to the public, and only during
14	16		periods:
15	17		(1) beginning June 24 and ending at midnight on July 4;
16	18		(2) beginning five days before the first Monday in
17	19		September and ending at midnight on the first Monday in September in
18	20		a county in which the commissioners court of the county has approved
19	21		the sale of fireworks during the period;
20	22		(3) beginning December 20 and ending at midnight on
21	23		January 1 of the following year; and
22	24		(4) [(3)] beginning May 1 and ending at midnight on
23	25		May 5 if the fireworks are sold at a location that is not more than
24	26		100 miles from the Texas-Mexico border and that is in a county in
25	27		which the commissioners court of the county has approved the sale of
26	28		fireworks during the period.
27	29		SECTION 2. Sections 352.051(b) and (d), Local Government
28	30		Code, are amended to read as follows:
29	31		(b)(1) The Texas A&M Forest Service in the ordinary course
30	32		of its activities shall determine whether drought conditions, as
31	33		defined under Subsection (a)(2), exist on average in any county
32	34		requesting such a determination. The Texas A&M Forest Service
33	35		shall make available the measurement index guidelines used to
34	36		determine whether drought conditions exist in a particular area.
35	37		Following any determination that such drought conditions exist, the
36	38		Texas A&M Forest Service shall notify said county or counties when
37	39		such drought conditions no longer exist. The Texas A&M Forest
38	40		Service shall make its services available each day during the Texas
39	41		Independence Day, San Jacinto Day, Memorial Day, Fourth of July,
40	42		Labor Day, and December fireworks seasons to respond to the request
41	43		of any county for a determination whether drought conditions exist
42	44		on average in the county.
43	45		(2) The Texas A&M Forest Service shall be allowed to
44	46		take such donations of equipment or funds as necessary to aid in the
45	47		carrying out of this section.
46	48		(d) To facilitate compliance with an order adopted under
47	49		Subsection (c), the order must be adopted before:
48	50		(1) February 15 of each year for the Texas
49	51		Independence Day fireworks season;
50	52		(2) April 1 of each year for the San Jacinto Day
51	53		fireworks season;
52	54		(3) April 25 of each year for the Cinco de Mayo
53	55		fireworks season;
54	56		(4) May 15 of each year for the Memorial Day fireworks
55	57		season;
56	58		(5) June 15 of each year for the Fourth of July
57	59		fireworks season; [and]
58	60		(6) August 15 of each year for the Labor Day fireworks
59	61		season; and
60	62		(7) December 15 of each year for each December
61	63		fireworks season.
62	64		SECTION 3. This Act takes effect immediately if it receives
63	65		a vote of two-thirds of all the members elected to each house, as
64	66		provided by Section 39, Article III, Texas Constitution. If this
65	67		Act does not receive the vote necessary for immediate effect, this
66	68		Act takes effect September 1, 2021.
