55 AN ACT
66 relating to a Medicaid buy-in program for Medicaid recipients with
77 increased household income from employment.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1010 amended by adding Section 531.024442 to read as follows:
1111 Sec. 531.024442. MEDICAID BUY-IN PROGRAM FOR CERTAIN
1212 PERSONS WITH INCREASED HOUSEHOLD INCOME FROM EMPLOYMENT. (a) The
1313 commission shall operate a Medicaid buy-in program for Medicaid
1414 recipients:
1515 (1) who are not eligible for a Medicaid buy-in program
1616 established under Section 531.02444; and
1717 (2) whose eligibility for Medicaid is otherwise being
1818 terminated solely because of an increase in household income
1919 received from employment.
2020 (b) The program under this section must be substantively
2121 identical to the Medicaid buy-in programs for persons with
2222 disabilities established under Section 531.02444, except to the
2323 extent that programmatic differences are appropriate because of the
2424 populations served by the programs.
2525 (c) The executive commissioner shall adopt rules for
2626 participation in the program under this section that provide for:
2727 (1) eligibility requirements, including household
2828 income limits for participation; and
2929 (2) requirements for program participants to pay
3030 premiums or cost-sharing payments.
3131 SECTION 2. Not later than January 1, 2022, the executive
3232 commissioner of the Health and Human Services Commission shall
3333 adopt the rules required by Section 531.024442, Government Code, as
3434 added by this Act, and the commission shall implement the program
3535 required by that section.
3636 SECTION 3. If before implementing any provision of this Act
3737 a state agency determines that a waiver or authorization from a
3838 federal agency is necessary for implementation of that provision,
3939 the agency affected by the provision shall request the waiver or
4040 authorization and may delay implementing that provision until the
4141 waiver or authorization is granted.
4242 SECTION 4. This Act takes effect September 1, 2021.
