44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to a study by the Texas Education Agency regarding
77 recommended standards for school district facility maintenance and
88 custodial services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITION. In this Act, "agency" means the
1111 Texas Education Agency.
1212 SECTION 2. STUDY REGARDING RECOMMENDED STANDARDS FOR
1313 MAINTENANCE AND CUSTODIAL SERVICES. (a) The agency shall conduct a
1414 study regarding recommended standards for school district
1515 maintenance of facilities and custodial services, including a
1616 standard for appropriate custodial workloads to adequately
1717 maintain a school district's facilities.
1818 (b) In conducting the study, the agency shall consider:
1919 (1) the square footage of a typical elementary,
2020 middle, and high school;
2121 (2) the square footage of administrative and district
2222 facilities other than instructional facilities in a typical school
2323 district;
2424 (3) appropriate levels of custodial service to provide
2525 for proper maintenance of school district facilities; and
2626 (4) the time required for different levels of
2727 custodial service based on different numbers of custodial employees
2828 and resources.
2929 (c) The study must identify:
3030 (1) the maintenance and custodial staff needed to
3131 adequately meet a typical school district's needs;
3232 (2) the tasks required to be completed by maintenance
3333 and custodial staff, including time estimates for completion of
3434 each task by an adequately equipped maintenance and custodial
3535 staff; and
3636 (3) any additional funding or other resources, if any,
3737 needed by school districts to meet the standards recommended by the
3838 study for school district maintenance of facilities and custodial
3939 services.
4040 SECTION 3. REPORT TO LEGISLATURE. Not later than December
4141 1, 2022, the agency shall submit a report to the legislature that
4242 includes the results of the study conducted under Section 2 of this
4343 Act and any associated recommendations.
4444 SECTION 4. EXPIRATION. This Act expires September 1, 2023.
4545 SECTION 5. EFFECTIVE DATE. This Act takes effect
4646 immediately if it receives a vote of two-thirds of all the members
4747 elected to each house, as provided by Section 39, Article III, Texas
4848 Constitution. If this Act does not receive the vote necessary for
4949 immediate effect, this Act takes effect September 1, 2021.
