| 6 | 6 | | relating to a study by the Texas Education Agency regarding |
|---|
| 7 | 7 | | recommended standards for school district facility maintenance and |
|---|
| 8 | 8 | | custodial services. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. DEFINITION. In this Act, "agency" means the |
|---|
| 11 | 11 | | Texas Education Agency. |
|---|
| 12 | 12 | | SECTION 2. STUDY REGARDING RECOMMENDED STANDARDS FOR |
|---|
| 13 | 13 | | MAINTENANCE AND CUSTODIAL SERVICES. (a) The agency shall conduct a |
|---|
| 14 | 14 | | study regarding recommended standards for school district |
|---|
| 15 | 15 | | maintenance of facilities and custodial services, including a |
|---|
| 16 | 16 | | standard for appropriate custodial workloads to adequately |
|---|
| 17 | 17 | | maintain a school district's facilities. |
|---|
| 18 | 18 | | (b) In conducting the study, the agency shall consider: |
|---|
| 19 | 19 | | (1) the square footage of a typical elementary, |
|---|
| 20 | 20 | | middle, and high school; |
|---|
| 21 | 21 | | (2) the square footage of administrative and district |
|---|
| 22 | 22 | | facilities other than instructional facilities in a typical school |
|---|
| 23 | 23 | | district; |
|---|
| 24 | 24 | | (3) appropriate levels of custodial service to provide |
|---|
| 25 | 25 | | for proper maintenance of school district facilities; and |
|---|
| 26 | 26 | | (4) the time required for different levels of |
|---|
| 27 | 27 | | custodial service based on different numbers of custodial employees |
|---|
| 28 | 28 | | and resources. |
|---|
| 29 | 29 | | (c) The study must identify: |
|---|
| 30 | 30 | | (1) the maintenance and custodial staff needed to |
|---|
| 31 | 31 | | adequately meet a typical school district's needs; |
|---|
| 32 | 32 | | (2) the tasks required to be completed by maintenance |
|---|
| 33 | 33 | | and custodial staff, including time estimates for completion of |
|---|
| 34 | 34 | | each task by an adequately equipped maintenance and custodial |
|---|
| 35 | 35 | | staff; and |
|---|
| 36 | 36 | | (3) any additional funding or other resources, if any, |
|---|
| 37 | 37 | | needed by school districts to meet the standards recommended by the |
|---|
| 38 | 38 | | study for school district maintenance of facilities and custodial |
|---|
| 39 | 39 | | services. |
|---|
| 40 | 40 | | SECTION 3. REPORT TO LEGISLATURE. Not later than December |
|---|
| 41 | 41 | | 1, 2022, the agency shall submit a report to the legislature that |
|---|
| 42 | 42 | | includes the results of the study conducted under Section 2 of this |
|---|
| 43 | 43 | | Act and any associated recommendations. |
|---|
| 44 | 44 | | SECTION 4. EXPIRATION. This Act expires September 1, 2023. |
|---|
| 45 | 45 | | SECTION 5. EFFECTIVE DATE. This Act takes effect |
|---|
| 46 | 46 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 47 | 47 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 48 | 48 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 49 | 49 | | immediate effect, this Act takes effect September 1, 2021. |
