44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the registration of voters at a polling place during
77 early voting by personal appearance and related procedures.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 12, Election Code, is
1010 amended by adding Section 12.007 to read as follows:
1111 Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER
1212 REGISTRARS. An election officer serving a polling place for early
1313 voting by personal appearance is a deputy voter registrar and has
1414 the same authority as a regular deputy registrar.
1515 SECTION 2. Section 65.054, Election Code, is amended by
1616 adding Subsection (b-1) to read as follows:
1717 (b-1) A provisional ballot cast under Section 85.0312 shall
1818 be accepted if the voter registrar determines the applicant is
1919 eligible for registration under Section 85.0312(d).
2020 SECTION 3. Subchapter B, Chapter 85, Election Code, is
2121 amended by adding Section 85.0312 to read as follows:
2222 Sec. 85.0312. REGISTRATION AT POLLING PLACE DURING EARLY
2323 VOTING. (a) A person who would be eligible to vote in an election
2424 under Section 11.001, but for the requirement to be a registered
2525 voter, shall be accepted during early voting by personal appearance
2626 for voting the ballot for the precinct of the person's residence as
2727 shown by the identification presented if, on the day the person
2828 offers to vote, the person:
2929 (1) submits a voter registration application that
3030 complies with Section 13.002 to an election officer at the polling
3131 place; and
3232 (2) presents as proof of residence:
3333 (A) a Texas driver's license, including a
3434 temporary license or instruction permit, or personal
3535 identification card issued to the person by the Department of
3636 Public Safety that states the person's current address on the day
3737 the person seeks to vote; or
3838 (B) a utility bill addressed to the person dated
3939 not earlier than the 30th day before the date the person seeks to
4040 vote, and:
4141 (i) a driver's license or personal
4242 identification card issued to the person by the Department of
4343 Public Safety that has not expired or that expired no earlier than
4444 60 days before the date of presentation;
4545 (ii) a United States military
4646 identification card that contains the person's photograph that has
4747 not expired or that expired no earlier than 60 days before the date
4848 of presentation;
4949 (iii) a United States citizenship
5050 certificate issued to the person that contains the person's
5151 photograph;
5252 (iv) a United States passport issued to the
5353 person that has not expired or that expired no earlier than 60 days
5454 before the date of presentation;
5555 (v) a license to carry a handgun issued to
5656 the person by the Department of Public Safety that has not expired
5757 or that expired no earlier than 60 days before the date of
5858 presentation; or
5959 (vi) a student identification card issued
6060 by a public or private institution of higher education located in
6161 this state that contains the person's photograph.
6262 (b) The election officer shall make a copy of the proof of
6363 residence submitted under Subsection (a)(2) and attach it to the
6464 registration application. The election officer shall return the
6565 original proof of residence to the voter.
6666 (c) A person voting under this section shall vote a
6767 provisional ballot in the manner provided by Section 63.011 except
6868 that the person is not required to submit the affidavit under
6969 Section 63.011(a).
7070 (d) For each registration corresponding to a ballot cast
7171 under this section, the voter registrar shall review the
7272 application and copy of the proof of residence and determine
7373 whether the applicant is eligible for registration as provided by
7474 Subchapter C, Chapter 13. The registrar shall inform the early
7575 voting ballot board of a determination made under this subsection.
7676 A registration approved under this subsection takes effect on the
7777 date the vote was cast.
7878 (e) The secretary of state may by rule:
7979 (1) designate additional documents that a person may
8080 offer to prove the person's residence to register and vote under
8181 this section; and
8282 (2) prescribe procedures to implement this section.
8383 SECTION 4. This Act takes effect September 1, 2021.
