| 7 | 7 | | early voting by personal appearance and related procedures. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 12, Election Code, is |
|---|
| 10 | 10 | | amended by adding Section 12.007 to read as follows: |
|---|
| 11 | 11 | | Sec. 12.007. CERTAIN ELECTION OFFICERS ARE VOTER |
|---|
| 12 | 12 | | REGISTRARS. An election officer serving a polling place for early |
|---|
| 13 | 13 | | voting by personal appearance is a deputy voter registrar and has |
|---|
| 14 | 14 | | the same authority as a regular deputy registrar. |
|---|
| 15 | 15 | | SECTION 2. Section 65.054, Election Code, is amended by |
|---|
| 16 | 16 | | adding Subsection (b-1) to read as follows: |
|---|
| 17 | 17 | | (b-1) A provisional ballot cast under Section 85.0312 shall |
|---|
| 18 | 18 | | be accepted if the voter registrar determines the applicant is |
|---|
| 19 | 19 | | eligible for registration under Section 85.0312(d). |
|---|
| 20 | 20 | | SECTION 3. Subchapter B, Chapter 85, Election Code, is |
|---|
| 21 | 21 | | amended by adding Section 85.0312 to read as follows: |
|---|
| 22 | 22 | | Sec. 85.0312. REGISTRATION AT POLLING PLACE DURING EARLY |
|---|
| 23 | 23 | | VOTING. (a) A person who would be eligible to vote in an election |
|---|
| 24 | 24 | | under Section 11.001, but for the requirement to be a registered |
|---|
| 25 | 25 | | voter, shall be accepted during early voting by personal appearance |
|---|
| 26 | 26 | | for voting the ballot for the precinct of the person's residence as |
|---|
| 27 | 27 | | shown by the identification presented if, on the day the person |
|---|
| 28 | 28 | | offers to vote, the person: |
|---|
| 29 | 29 | | (1) submits a voter registration application that |
|---|
| 30 | 30 | | complies with Section 13.002 to an election officer at the polling |
|---|
| 31 | 31 | | place; and |
|---|
| 32 | 32 | | (2) presents as proof of residence: |
|---|
| 33 | 33 | | (A) a Texas driver's license, including a |
|---|
| 34 | 34 | | temporary license or instruction permit, or personal |
|---|
| 35 | 35 | | identification card issued to the person by the Department of |
|---|
| 36 | 36 | | Public Safety that states the person's current address on the day |
|---|
| 37 | 37 | | the person seeks to vote; or |
|---|
| 38 | 38 | | (B) a utility bill addressed to the person dated |
|---|
| 39 | 39 | | not earlier than the 30th day before the date the person seeks to |
|---|
| 40 | 40 | | vote, and: |
|---|
| 41 | 41 | | (i) a driver's license or personal |
|---|
| 42 | 42 | | identification card issued to the person by the Department of |
|---|
| 43 | 43 | | Public Safety that has not expired or that expired no earlier than |
|---|
| 44 | 44 | | 60 days before the date of presentation; |
|---|
| 45 | 45 | | (ii) a United States military |
|---|
| 46 | 46 | | identification card that contains the person's photograph that has |
|---|
| 47 | 47 | | not expired or that expired no earlier than 60 days before the date |
|---|
| 48 | 48 | | of presentation; |
|---|
| 49 | 49 | | (iii) a United States citizenship |
|---|
| 50 | 50 | | certificate issued to the person that contains the person's |
|---|
| 51 | 51 | | photograph; |
|---|
| 52 | 52 | | (iv) a United States passport issued to the |
|---|
| 53 | 53 | | person that has not expired or that expired no earlier than 60 days |
|---|
| 54 | 54 | | before the date of presentation; |
|---|
| 55 | 55 | | (v) a license to carry a handgun issued to |
|---|
| 56 | 56 | | the person by the Department of Public Safety that has not expired |
|---|
| 57 | 57 | | or that expired no earlier than 60 days before the date of |
|---|
| 58 | 58 | | presentation; or |
|---|
| 59 | 59 | | (vi) a student identification card issued |
|---|
| 60 | 60 | | by a public or private institution of higher education located in |
|---|
| 61 | 61 | | this state that contains the person's photograph. |
|---|
| 62 | 62 | | (b) The election officer shall make a copy of the proof of |
|---|
| 63 | 63 | | residence submitted under Subsection (a)(2) and attach it to the |
|---|
| 64 | 64 | | registration application. The election officer shall return the |
|---|
| 65 | 65 | | original proof of residence to the voter. |
|---|
| 66 | 66 | | (c) A person voting under this section shall vote a |
|---|
| 67 | 67 | | provisional ballot in the manner provided by Section 63.011 except |
|---|
| 68 | 68 | | that the person is not required to submit the affidavit under |
|---|
| 69 | 69 | | Section 63.011(a). |
|---|
| 70 | 70 | | (d) For each registration corresponding to a ballot cast |
|---|
| 71 | 71 | | under this section, the voter registrar shall review the |
|---|
| 72 | 72 | | application and copy of the proof of residence and determine |
|---|
| 73 | 73 | | whether the applicant is eligible for registration as provided by |
|---|
| 74 | 74 | | Subchapter C, Chapter 13. The registrar shall inform the early |
|---|
| 75 | 75 | | voting ballot board of a determination made under this subsection. |
|---|
| 76 | 76 | | A registration approved under this subsection takes effect on the |
|---|
| 77 | 77 | | date the vote was cast. |
|---|
| 78 | 78 | | (e) The secretary of state may by rule: |
|---|
| 79 | 79 | | (1) designate additional documents that a person may |
|---|
| 80 | 80 | | offer to prove the person's residence to register and vote under |
|---|
| 81 | 81 | | this section; and |
|---|
| 82 | 82 | | (2) prescribe procedures to implement this section. |
|---|
| 83 | 83 | | SECTION 4. This Act takes effect September 1, 2021. |
