66 AN ACT
77 relating to the establishment of the Science, Technology,
88 Engineering, and Mathematics (STEM) Scholarship Program for
99 certain students at public institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 61, Education Code, is amended by adding
1212 Subchapter LL to read as follows:
1313 SUBCHAPTER LL. SCIENCE, TECHNOLOGY, ENGINEERING, AND MATHEMATICS
1414 (STEM) SCHOLARSHIP PROGRAM
1515 Sec. 61.9851. DEFINITION. In this subchapter, "STEM
1616 program" means a science, technology, engineering, or mathematics
1717 program.
1818 Sec. 61.9852. SCHOLARSHIP PROGRAM. (a) For purposes of
1919 Section 49-g(c-3), Article III, Texas Constitution, the Science,
2020 Technology, Engineering, and Mathematics (STEM) Scholarship
2121 Program is established to provide eligible students with
2222 scholarships to attend a STEM program at an institution of higher
2323 education.
2424 (b) The board shall establish and administer the
2525 scholarship program in accordance with this subchapter and board
2626 rules.
2727 Sec. 61.9853. ELIGIBILITY. (a) To receive an initial
2828 scholarship under this subchapter, a student must:
2929 (1) be a citizen or lawful permanent resident of the
3030 United States;
3131 (2) be a Texas resident under Section 54.052;
3232 (3) enroll in a STEM program at an institution of
3333 higher education; and
3434 (4) comply with any other eligibility requirements
3535 established by board rule.
3636 (b) To continue to qualify for a scholarship under this
3737 subchapter, a student must:
3838 (1) remain enrolled in a STEM program at an
3939 institution of higher education;
4040 (2) make satisfactory academic progress as determined
4141 by board rule; and
4242 (3) comply with any other eligibility requirements
4343 established by board rule.
4444 Sec. 61.9854. AMOUNT; FUNDING. From funds retained as
4545 general revenue under Section 49-g(c-3), Article III, Texas
4646 Constitution, and appropriated for that purpose and from any other
4747 available funds, the board shall award scholarships in an amount
4848 determined by board rule to eligible students under the scholarship
4949 program.
5050 SECTION 2. The Texas Higher Education Coordinating Board
5151 shall begin awarding scholarships under Subchapter LL, Chapter 61,
5252 Education Code, as added by this Act, for the first academic year
5353 for which money is appropriated for that purpose, except that the
5454 coordinating board may not award scholarships under that subchapter
5555 for an academic year before the 2023-2024 academic year.
5656 SECTION 3. This Act takes effect January 1, 2022, but only
5757 if the constitutional amendment proposed by the 87th Legislature,
5858 Regular Session, 2021, to reduce the allocation of certain general
5959 revenue to the economic stabilization fund and to use that revenue
6060 for certain science, technology, engineering, and mathematics
6161 (STEM) scholarships is approved by the voters. If that
6262 constitutional amendment is not approved by the voters, this Act
6363 has no effect.
