55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to law enforcement policies requiring a peace officer to
88 intervene when another peace officer uses excessive force or
99 commits an offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2, Code of Criminal Procedure, is
1212 amended by adding Article 2.33 to read as follows:
1313 Art. 2.33. LAW ENFORCEMENT POLICY ON INTERVENTION. (a) In
1414 this article, "law enforcement agency" means an agency of the state
1515 or an agency of a political subdivision of the state authorized by
1616 law to employ peace officers.
1717 (b) Each law enforcement agency in this state shall adopt a
1818 detailed written policy requiring peace officers employed by the
1919 agency to intervene to stop or prevent another peace officer from:
2020 (1) using excessive force against a person suspected
2121 of committing an offense, if an ordinary, prudent peace officer
2222 would intervene under the same or similar circumstances; or
2323 (2) committing an offense.
2424 SECTION 2. Not later than January 1, 2022, each law
2525 enforcement agency in this state shall adopt the policy required by
2626 Article 2.33, Code of Criminal Procedure, as added by this Act.
2727 SECTION 3. This Act takes effect September 1, 2021.
