10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
12 | 12 | amended by adding Article 2.33 to read as follows: | |
13 | 13 | Art. 2.33. LAW ENFORCEMENT POLICY ON INTERVENTION. (a) In | |
14 | 14 | this article, "law enforcement agency" means an agency of the state | |
15 | 15 | or an agency of a political subdivision of the state authorized by | |
16 | 16 | law to employ peace officers. | |
17 | 17 | (b) Each law enforcement agency in this state shall adopt a | |
18 | 18 | detailed written policy requiring peace officers employed by the | |
19 | 19 | agency to intervene to stop or prevent another peace officer from: | |
20 | 20 | (1) using excessive force against a person suspected | |
21 | 21 | of committing an offense, if an ordinary, prudent peace officer | |
22 | 22 | would intervene under the same or similar circumstances; or | |
23 | 23 | (2) committing an offense. | |
24 | 24 | SECTION 2. Not later than January 1, 2022, each law | |
25 | 25 | enforcement agency in this state shall adopt the policy required by | |
26 | 26 | Article 2.33, Code of Criminal Procedure, as added by this Act. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
