5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to a Department of Family and Protective Services report
8	8	on youth in the managing conservatorship of the department who are
9	9	pregnant or who are parents.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 264.017(b), Family Code, is amended to
12	12	read as follows:
13	13	(b) The department shall provide the report required by
14	14	Subsection (a) to the legislature and shall publish the report and
15	15	make the report available electronically to the public not later
16	16	than February 1 of each year. The report must include, with respect
17	17	to the preceding year:
18	18	(1) information on the number and disposition of
19	19	reports of child abuse and neglect received by the department;
20	20	(2) information on the number of clients for whom the
21	21	department took protective action, including investigations,
22	22	alternative responses, and court-ordered removals;
23	23	(3) information on the number of clients for whom the
24	24	department provided services in each program administered by the
25	25	child protective services division, including investigations,
26	26	alternative responses, family-based safety services,
27	27	conservatorship, post-adoption services, and transitional living
28	28	services;
29	29	(4) the number of children in this state who died as a
30	30	result of child abuse or neglect;
31	31	(5) the number of children described by Subdivision
32	32	(4) for whom the department was the children's managing conservator
33	33	at the time of death;
34	34	(6) information on the timeliness of the department's
35	35	initial contact in an investigation or alternative response;
36	36	(7) information on the response time by the department
37	37	in commencing services to families and children for whom an
38	38	allegation of child abuse or neglect has been made;
39	39	(8) information regarding child protection staffing
40	40	and caseloads by program area;
41	41	(9) information on the permanency goals in place and
42	42	achieved for children in the managing conservatorship of the
43	43	department, including information on the timeliness of achieving
44	44	the goals, the stability of the children's placement in foster
45	45	care, and the proximity of placements to the children's home
46	46	counties;
47	47	(10) the number of children who suffer from a severe
48	48	emotional disturbance and for whom the department is appointed
49	49	managing conservator, including statistics on appointments as
50	50	joint managing conservator, due to an individual voluntarily
51	51	relinquishing custody of a child solely to obtain mental health
52	52	services for the child;
53	53	(11) the following information regarding [number of]
54	54	children who are pregnant or who are parents [a parent] while in the
55	55	managing conservatorship of the department:
56	56	(A) the number of pregnant female children who
57	57	are at least 13 years of age but younger than 18 years of age
58	58	compared to the total number of female children who are at least 13
59	59	years of age but younger than 18 years of age;
60	60	(B) the number of female children who are at
61	61	least 13 years of age but younger than 18 years of age and who have
62	62	given birth to a child compared to the total number of female
63	63	children who are at least 13 years of age but younger than 18 years
64	64	of age;
65	65	(C) the number of pregnant female youth who are
66	66	younger than 22 years of age and the following information for each
67	67	youth:
68	68	(i) the youth's age;
69	69	(ii) the youth's race and ethnicity;
70	70	(iii) the youth's county of residence;
71	71	(iv) the time the youth has been in
72	72	substitute care; and
73	73	(v) the type of substitute care in which the
74	74	youth is placed;
75	75	(D) the number of youth who are younger than 22
76	76	years of age and who are parents and the following information for
77	77	each youth:
78	78	(i) the youth's gender;
79	79	(ii) the youth's age;
80	80	(iii) the youth's race and ethnicity;
81	81	(iv) the youth's county of residence;
82	82	(v) the time the youth has been in
83	83	substitute care; and
84	84	(vi) the type of substitute care in which
85	85	the youth is placed;
86	86	(E) the number of youth who are parents of at
87	87	least one child who is also in the managing conservatorship of the
88	88	department and the following information for each youth:
89	89	(i) the type of substitute care in which the
90	90	youth is placed; and
91	91	(ii) whether the youth and the child are
92	92	placed together;
93	93	(F) for youth described by Paragraphs (C) and (D)
94	94	who exit the department's conservatorship, the following
95	95	information for each youth:
96	96	(i) whether the youth is adopted, reunited
97	97	with the youth's family, or emancipated;
98	98	(ii) the youth's age on the date the youth
99	99	exited the department's conservatorship; and
100	100	(iii) the time the youth spent in
101	101	substitute care;
102	102	(G) the number of children who are at least 11
103	103	years of age but younger than 18 years of age and who are pregnant or
104	104	who are parents at the time the child enters the conservatorship of
105	105	the department; and
106	106	(H) the number of children who are at least 11
107	107	years of age but younger than 18 years of age and who become
108	108	pregnant or who become parents while in the conservatorship of the
109	109	department [and the number of the children born to a parent in the
110	110	managing conservatorship of the department who are placed in the
111	111	managing conservatorship of the department];
112	112	(12) the number of children who are missing from the
113	113	children's substitute care provider while in the managing
114	114	conservatorship of the department; and
115	115	(13) the number of children who were victims of
116	116	trafficking under Chapter 20A, Penal Code, while in the managing
117	117	conservatorship of the department.
118	118	SECTION 2. This Act takes effect September 1, 2021.
