66 AN ACT
77 relating to identification cards issued by health maintenance
88 organizations and preferred provider organizations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 843.209, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 843.209. IDENTIFICATION CARD. (a) An identification
1313 card or other similar document issued by a health maintenance
1414 organization to an enrollee must:
1515 (1) indicate that the health maintenance organization
1616 is regulated under this code and subject to the provisions of
1717 Subchapter J; [and]
1818 (2) display:
1919 (A) the first date on which the enrollee became
2020 enrolled; or
2121 (B) a toll-free number a physician or provider
2222 may use to obtain that date; and
2323 (3) display the acronym "HMO" in the location of the
2424 health maintenance organization's choice.
2525 (b) An identification card or other similar document that
2626 bears the acronym "HMO" as required by Subsection (a) indicates
2727 that health benefit coverage for health care services provided by a
2828 participating physician or provider does not ensure the enrollee
2929 has access to:
3030 (1) health care services at a discounted rate if the
3131 services are provided by a physician or provider who is not included
3232 in the health maintenance organization delivery network; or
3333 (2) other fee discounts available under the health
3434 maintenance organization delivery network.
3535 SECTION 2. Section 1301.162, Insurance Code, is amended to
3636 read as follows:
3737 Sec. 1301.162. IDENTIFICATION CARD. (a) An identification
3838 card or other similar document issued by an insurer regulated by
3939 this code and subject to this chapter to an individual insured must:
4040 (1) display:
4141 (A) [(1)] the first date on which the individual
4242 became insured under the plan; or
4343 (B) [(2)] a toll-free number a physician or
4444 health care provider may use to obtain that date; and
4545 (2) display the acronym "PPO" in the location of the
4646 insurer's choice.
4747 (b) An identification card or other similar document that
4848 bears the acronym "PPO" as required by Subsection (a) indicates
4949 that health benefit coverage for medical care or health care
5050 services provided by a preferred provider does not ensure the
5151 insured has access to:
5252 (1) medical care or health care services at a
5353 discounted rate if the services are provided by an out-of-network
5454 provider; or
5555 (2) other fee discounts available under the provider
5656 network.
5757 SECTION 3. Sections 843.209 and 1301.162, Insurance Code,
5858 as amended by this Act, apply only to an identification card or
5959 other similar document issued on or after January 1, 2022.
6060 SECTION 4. This Act takes effect September 1, 2021.
