6	6	AN ACT
7	7	relating to the composition of districts for the election of
8	8	members of the Texas House of Representatives.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. The purpose of this Act is to fulfill the
11	11	legislature's duty under Section 28, Article III, Texas
12	12	Constitution, to redraw the districts for the election of the
13	13	members of the Texas House of Representatives in compliance with
14	14	the United States and Texas Constitutions and applicable federal
15	15	law following the publication of the 2020 federal decennial census.
16	16	SECTION 2. The districts from which the members of the Texas
17	17	House of Representatives are elected are the districts as provided
18	18	by law and used for the election of the members of the House of
19	19	Representatives of the 87th Legislature except as those districts
20	20	are changed by Section 3 of this Act.
21	21	SECTION 3. (a) The portion of House District 3 located in
22	22	Montgomery County tract 690401, block 1000, is transferred to House
23	23	District 15.
24	24	(b) The portion of House District 64 located in Denton
25	25	County tract 020800, block 1041, is transferred to House District
26	26	63.
27	27	(c) The portion of House District 93 located in Tarrant
28	28	County tract 114103, block 1001, is transferred to House District
29	29	99.
30	30	SECTION 4. In this Act, "tract," "block group," and "block"
31	31	mean the geographic areas identified by those terms on the 2010
32	32	Census TIGER/Line Shapefiles, prepared by the federal Bureau of the
33	33	Census for the Twenty-third Decennial Census of the United States,
34	34	enumerated as of April 1, 2010.
35	35	SECTION 5. It is the intent of the legislature that if any
36	36	county, tract, block group, block, or other geographic area has
37	37	erroneously been left out of this Act, a court reviewing this Act
38	38	should include that area in the appropriate district in accordance
39	39	with the intent of the legislature, using any available evidence of
40	40	that intent, including evidence such as that used by the Supreme
41	41	Court of Texas in Smith v. Patterson, 111 Tex. 535, 242 S.W. 749
42	42	(1922).
43	43	SECTION 6. (a) This Act supersedes all previous enactments
44	44	or orders adopting districts for the Texas House of
45	45	Representatives. All previous acts of the legislature adopting
46	46	districts for the Texas House of Representatives are repealed.
47	47	(b) Chapter 2 (S.B. 3), Acts of the 83rd Legislature, 1st
48	48	Called Session, 2013 (Article 195a-13, Vernon's Texas Civil
49	49	Statutes), is repealed.
50	50	SECTION 7. The districts established in this Act apply to
51	51	the election of the members of the Texas House of Representatives
52	52	beginning with the primary and general elections in 2022 for
53	53	members of the 88th Legislature. This Act does not affect the
54	54	membership or districts of the House of Representatives of the 87th
55	55	Texas Legislature.
56	56	SECTION 8. This Act takes effect immediately if it receives
57	57	a vote of two-thirds of all the members elected to each house, as
58	58	provided by Section 39, Article III, Texas Constitution. If this
59	59	Act does not receive the vote necessary for immediate effect, this
60	60	Act takes effect September 1, 2021.
