55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the composition of districts for the election of
88 members of the Texas House of Representatives.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The purpose of this Act is to fulfill the
1111 legislature's duty under Section 28, Article III, Texas
1212 Constitution, to redraw the districts for the election of the
1313 members of the Texas House of Representatives in compliance with
1414 the United States and Texas Constitutions and applicable federal
1515 law following the publication of the 2020 federal decennial census.
1616 SECTION 2. The districts from which the members of the Texas
1717 House of Representatives are elected are the districts as provided
1818 by law and used for the election of the members of the House of
1919 Representatives of the 87th Legislature except as those districts
2020 are changed by Section 3 of this Act.
2121 SECTION 3. (a) The portion of House District 3 located in
2222 Montgomery County tract 690401, block 1000, is transferred to House
2323 District 15.
2424 (b) The portion of House District 64 located in Denton
2525 County tract 020800, block 1041, is transferred to House District
2626 63.
2727 (c) The portion of House District 93 located in Tarrant
2828 County tract 114103, block 1001, is transferred to House District
2929 99.
3030 SECTION 4. In this Act, "tract," "block group," and "block"
3131 mean the geographic areas identified by those terms on the 2010
3232 Census TIGER/Line Shapefiles, prepared by the federal Bureau of the
3333 Census for the Twenty-third Decennial Census of the United States,
3434 enumerated as of April 1, 2010.
3535 SECTION 5. It is the intent of the legislature that if any
3636 county, tract, block group, block, or other geographic area has
3737 erroneously been left out of this Act, a court reviewing this Act
3838 should include that area in the appropriate district in accordance
3939 with the intent of the legislature, using any available evidence of
4040 that intent, including evidence such as that used by the Supreme
4141 Court of Texas in Smith v. Patterson, 111 Tex. 535, 242 S.W. 749
4242 (1922).
4343 SECTION 6. (a) This Act supersedes all previous enactments
4444 or orders adopting districts for the Texas House of
4545 Representatives. All previous acts of the legislature adopting
4646 districts for the Texas House of Representatives are repealed.
4747 (b) Chapter 2 (S.B. 3), Acts of the 83rd Legislature, 1st
4848 Called Session, 2013 (Article 195a-13, Vernon's Texas Civil
4949 Statutes), is repealed.
5050 SECTION 7. The districts established in this Act apply to
5151 the election of the members of the Texas House of Representatives
5252 beginning with the primary and general elections in 2022 for
5353 members of the 88th Legislature. This Act does not affect the
5454 membership or districts of the House of Representatives of the 87th
5555 Texas Legislature.
5656 SECTION 8. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2021.
