8	5		AN ACT
9	6		relating to the use of certain data collected by the Texas Workforce
10	7		Commission to determine general prevailing wage rates for certain
11	8		public work contracts.
12	9		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	10		SECTION 1. Section 2258.022(a), Government Code, is amended
14	11		to read as follows:
15	12		(a) For a contract for a public work awarded by a political
16	13		subdivision of the state, the public body shall determine the
17	14		general prevailing rate of per diem wages in the locality in which
18	15		the public work is to be performed for each craft or type of worker
19	16		needed to execute the contract and the prevailing rate for legal
20	17		holiday and overtime work by:
21	18		(1) conducting a survey of the wages received by
22	19		classes of workers employed on projects of a character similar to
23	20		the contract work in the political subdivision of the state in which
24	21		the public work is to be performed; [or]
25	22		(2) using the prevailing wage rate as determined by
26	23		the United States Department of Labor in accordance with the
27	24		Davis-Bacon Act (40 U.S.C. Section 3141 [276a] et seq.), and its
28	25		subsequent amendments; or
29		-	(3) if each county in which the public work is located
30		-	has a population of less than one million, using the most recent
31		-	data, as of the time when the political subdivision submitted the
32		-	public work for bids or requested proposals, compiled by the Texas
33		-	Workforce Commission's Labor Market and Career Information
34		-	Department, including occupational employment statistics wage data
35		-	for:
	26	+	(3) using data compiled by the Texas Workforce
	27	+	Commission's Labor Market and Career Information Department,
	28	+	including occupational employment statistics wage data for:
36	29		(A) the local workforce development area or
37	30		metropolitan statistical area relating to the locality in which the
38	31		public work is performed; or
39	32		(B) the state, but only if there is no data
40	33		available for the relevant local workforce development area or the
41	34		metropolitan statistical area for the specific occupation, as
42		-	classified by the United States ~~Office~~ of ~~Management and Budget~~ in
43		-	~~the North American Industry~~ Classification System, for which data
44		-	is sought.

	36	+	2018 Standard Occupational Classification system, for which data is
	37	+	sought.
45	38		SECTION 2. The change in law made by this Act applies only
46	39		to a public work contract entered into or renewed on or after the
47	40		effective date of this Act.
48	41		SECTION 3. This Act takes effect September 1, 2021.
