44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the type of newspaper required for the publication of
77 notices by governmental entities or representatives in certain
88 counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2051.0441(b), Government Code, is
1111 amended to read as follows:
1212 (b) The newspaper in which a notice is published under this
1313 section must:
1414 (1) devote not less than 20 percent of its total column
1515 lineage to general interest items;
1616 (2) be published at least once each week;
1717 (3) meet one of the following requirements:
1818 (A) be entered as periodical postal matter in the
1919 county where published;
2020 (B) [or] have a mailed or delivered circulation
2121 of at least 51 percent of the residences in the county where
2222 published; or
2323 (C) for notices by a governmental entity or
2424 representative of the county or a political subdivision located in
2525 the county, be published in the county and designated by, as
2626 applicable, commissioners court order or official action of the
2727 governing body of the political subdivision as the newspaper for
2828 publication of notices; and
2929 (4) have been published regularly and continuously for
3030 at least 12 months before the governmental entity or representative
3131 publishes notice.
3232 SECTION 2. This Act takes effect September 1, 2021.
