| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 2051.0441(b), Government Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (b) The newspaper in which a notice is published under this | |
| 13 | 13 | section must: | |
| 14 | 14 | (1) devote not less than 20 percent of its total column | |
| 15 | 15 | lineage to general interest items; | |
| 16 | 16 | (2) be published at least once each week; | |
| 17 | 17 | (3) meet one of the following requirements: | |
| 18 | 18 | (A) be entered as periodical postal matter in the | |
| 19 | 19 | county where published; | |
| 20 | 20 | (B) [or] have a mailed or delivered circulation | |
| 21 | 21 | of at least 51 percent of the residences in the county where | |
| 22 | 22 | published; or | |
| 23 | 23 | (C) for notices by a governmental entity or | |
| 24 | 24 | representative of the county or a political subdivision located in | |
| 25 | 25 | the county, be published in the county and designated by, as | |
| 26 | 26 | applicable, commissioners court order or official action of the | |
| 27 | 27 | governing body of the political subdivision as the newspaper for | |
| 28 | 28 | publication of notices; and | |
| 29 | 29 | (4) have been published regularly and continuously for | |
| 30 | 30 | at least 12 months before the governmental entity or representative | |
| 31 | 31 | publishes notice. | |
| 32 | 32 | SECTION 2. This Act takes effect September 1, 2021. |
