55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirements for notice of a standard permit for
88 certain concrete plants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 382.05199, Health and Safety Code, is
1111 amended by amending Subsections (b) and (d) and adding Subsection
1212 (c-1) to read as follows:
1313 (b) An applicant for an authorization to use a standard
1414 permit under Section 382.05198 must publish and mail notice under
1515 this section not later than the earlier of:
1616 (1) the 30th day after the date the applicant receives
1717 written notice from the executive director that the application is
1818 technically complete; or
1919 (2) the 75th day after the date the executive director
2020 receives the application.
2121 (c-1) The applicant must mail written notice to each
2222 household within 880 yards of the proposed plant.
2323 (d) The notice under Subsections (c) and (c-1) must include:
2424 (1) a brief description of the proposed location and
2525 nature of the proposed plant;
2626 (2) a description, including a telephone number, of
2727 the manner in which the executive director may be contacted for
2828 further information;
2929 (3) a description, including a telephone number, of
3030 the manner in which the applicant may be contacted for further
3131 information;
3232 (4) the location and hours of operation of the
3333 commission's regional office at which a copy of the application is
3434 available for review and copying; and
3535 (5) a brief description of the public comment process,
3636 including the time and location of the public hearing, and the
3737 mailing address and deadline for filing written comments.
3838 SECTION 2. Section 382.05199, Health and Safety Code, as
3939 amended by this Act, applies only to an application for a permit
4040 that is filed with the Texas Commission on Environmental Quality on
4141 or after the effective date of this Act. An application for a
4242 permit filed before the effective date of this Act is governed by
4343 the law in effect on the date of filing, and that law is continued in
4444 effect for that purpose.
4545 SECTION 3. This Act takes effect September 1, 2021.
