| 7 | 7 | | relating to the requirements for notice of a standard permit for |
|---|
| 8 | 8 | | certain concrete plants. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 382.05199, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by amending Subsections (b) and (d) and adding Subsection |
|---|
| 12 | 12 | | (c-1) to read as follows: |
|---|
| 13 | 13 | | (b) An applicant for an authorization to use a standard |
|---|
| 14 | 14 | | permit under Section 382.05198 must publish and mail notice under |
|---|
| 15 | 15 | | this section not later than the earlier of: |
|---|
| 16 | 16 | | (1) the 30th day after the date the applicant receives |
|---|
| 17 | 17 | | written notice from the executive director that the application is |
|---|
| 18 | 18 | | technically complete; or |
|---|
| 19 | 19 | | (2) the 75th day after the date the executive director |
|---|
| 20 | 20 | | receives the application. |
|---|
| 21 | 21 | | (c-1) The applicant must mail written notice to each |
|---|
| 22 | 22 | | household within 880 yards of the proposed plant. |
|---|
| 23 | 23 | | (d) The notice under Subsections (c) and (c-1) must include: |
|---|
| 24 | 24 | | (1) a brief description of the proposed location and |
|---|
| 25 | 25 | | nature of the proposed plant; |
|---|
| 26 | 26 | | (2) a description, including a telephone number, of |
|---|
| 27 | 27 | | the manner in which the executive director may be contacted for |
|---|
| 28 | 28 | | further information; |
|---|
| 29 | 29 | | (3) a description, including a telephone number, of |
|---|
| 30 | 30 | | the manner in which the applicant may be contacted for further |
|---|
| 31 | 31 | | information; |
|---|
| 32 | 32 | | (4) the location and hours of operation of the |
|---|
| 33 | 33 | | commission's regional office at which a copy of the application is |
|---|
| 34 | 34 | | available for review and copying; and |
|---|
| 35 | 35 | | (5) a brief description of the public comment process, |
|---|
| 36 | 36 | | including the time and location of the public hearing, and the |
|---|
| 37 | 37 | | mailing address and deadline for filing written comments. |
|---|
| 38 | 38 | | SECTION 2. Section 382.05199, Health and Safety Code, as |
|---|
| 39 | 39 | | amended by this Act, applies only to an application for a permit |
|---|
| 40 | 40 | | that is filed with the Texas Commission on Environmental Quality on |
|---|
| 41 | 41 | | or after the effective date of this Act. An application for a |
|---|
| 42 | 42 | | permit filed before the effective date of this Act is governed by |
|---|
| 43 | 43 | | the law in effect on the date of filing, and that law is continued in |
|---|
| 44 | 44 | | effect for that purpose. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2021. |
