| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 662.003(b), Government Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (b) A state holiday includes only the following days: |
|---|
| 13 | 13 | | (1) the 19th day of January, "Confederate Heroes Day," |
|---|
| 14 | 14 | | in honor of Jefferson Davis, Robert E. Lee, and other Confederate |
|---|
| 15 | 15 | | heroes; |
|---|
| 16 | 16 | | (2) the second day of March, "Texas Independence Day"; |
|---|
| 17 | 17 | | (3) the 21st day of April, "San Jacinto Day"; |
|---|
| 18 | 18 | | (4) the 19th day of June, "Emancipation Day in Texas," |
|---|
| 19 | 19 | | in honor of the emancipation of the slaves in Texas in 1865; |
|---|
| 20 | 20 | | (5) the 27th day of August, "Lyndon Baines Johnson |
|---|
| 21 | 21 | | Day," in observance of the birthday of Lyndon Baines Johnson; |
|---|
| 22 | 22 | | (6) the Friday after Thanksgiving Day; |
|---|
| 23 | 23 | | (7) the 24th day of December; [and] |
|---|
| 24 | 24 | | (8) the 26th day of December; and |
|---|
| 25 | 25 | | (9) every day on which an election, including a |
|---|
| 26 | 26 | | primary election, is held throughout the state. |

| 27 | 27 | | SECTION 2. Section 662.021, Government Code, is amended to |
|---|
| 28 | 28 | | read as follows: |
|---|
| 29 | 29 | | Sec. 662.021. DATES OF HOLIDAYS. A legal holiday includes |
|---|
| 30 | 30 | | only the following days: |
|---|
| 31 | 31 | | (1) a national holiday under Section 662.003(a); and |
|---|
| 32 | 32 | | (2) a state holiday under Sections 662.003(b)(1) |
|---|
| 33 | 33 | | through (6) and Section 662.003(b)(9). |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2021. |
