55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the designation of certain election days as state
88 holidays.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 662.003(b), Government Code, is amended
1111 to read as follows:
1212 (b) A state holiday includes only the following days:
1313 (1) the 19th day of January, "Confederate Heroes Day,"
1414 in honor of Jefferson Davis, Robert E. Lee, and other Confederate
1515 heroes;
1616 (2) the second day of March, "Texas Independence Day";
1717 (3) the 21st day of April, "San Jacinto Day";
1818 (4) the 19th day of June, "Emancipation Day in Texas,"
1919 in honor of the emancipation of the slaves in Texas in 1865;
2020 (5) the 27th day of August, "Lyndon Baines Johnson
2121 Day," in observance of the birthday of Lyndon Baines Johnson;
2222 (6) the Friday after Thanksgiving Day;
2323 (7) the 24th day of December; [and]
2424 (8) the 26th day of December; and
2525 (9) every day on which an election, including a
2626 primary election, is held throughout the state.
2727 SECTION 2. Section 662.021, Government Code, is amended to
2828 read as follows:
2929 Sec. 662.021. DATES OF HOLIDAYS. A legal holiday includes
3030 only the following days:
3131 (1) a national holiday under Section 662.003(a); and
3232 (2) a state holiday under Sections 662.003(b)(1)
3333 through (6) and Section 662.003(b)(9).
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2021.
